    1                        A bill to be entitled                      
    2         An act relating to law enforcement explorers; amending
    3         s. 784.07, F.S.; defining the term “law enforcement
    4         explorer”; providing for reclassification of certain
    5         offenses against law enforcement explorers; reenacting
    6         s. 921.0022(3)(d), (f), and (g), F.S., relating to the
    7         offense severity ranking chart of the Criminal
    8         Punishment Code, to incorporate the amendments made to
    9         s. 784.07, F.S., in references thereto; providing an
   10         effective date.
   11         
   12  Be It Enacted by the Legislature of the State of Florida:
   13         
   14         Section 1. Subsections (1) and (2) of section 784.07,
   15  Florida Statutes, are amended to read:
   16         784.07 Assault or battery of law enforcement officers,
   17  firefighters, emergency medical care providers, public transit
   18  employees or agents, or other specified officers;
   19  reclassification of offenses; minimum sentences.—
   20         (1) As used in this section, the term:
   21         (a)(c) “Emergency medical care provider” means an ambulance
   22  driver, emergency medical technician, paramedic, registered
   23  nurse, physician as defined in s. 401.23, medical director as
   24  defined in s. 401.23, or any person authorized by an emergency
   25  medical service licensed under chapter 401 who is engaged in the
   26  performance of his or her duties. The term “emergency medical
   27  care provider” also includes physicians, employees, agents, or
   28  volunteers of hospitals as defined in chapter 395, who are
   29  employed, under contract, or otherwise authorized by a hospital
   30  to perform duties directly associated with the care and
   31  treatment rendered by the hospital's emergency department or the
   32  security thereof.
   33         (b) “Firefighter” means any person employed by any public
   34  employer of this state whose duty it is to extinguish fires; to
   35  protect life or property; or to enforce municipal, county, and
   36  state fire prevention codes, as well as any law pertaining to
   37  the prevention and control of fires.
   38         (c) “Law enforcement explorer” means any person who is a
   39  current member of a law enforcement agency's explorer post and
   40  who is performing basic law enforcement functions under the
   41  direction of a sworn officer and wearing a uniform that bears at
   42  least one patch that clearly identifies the law enforcement
   43  agency that he or she represents.
   44         (d)(a) “Law enforcement officer” includes a law enforcement
   45  officer, a correctional officer, a correctional probation
   46  officer, a part-time law enforcement officer, a part-time
   47  correctional officer, an auxiliary law enforcement officer, and
   48  an auxiliary correctional officer, as those terms are
   49  respectively defined in s. 943.10, and any county probation
   50  officer; an employee or agent of the Department of Corrections
   51  who supervises or provides services to inmates; an officer of
   52  the Parole Commission; a federal law enforcement officer as
   53  defined in s. 901.1505; and law enforcement personnel of the
   54  Fish and Wildlife Conservation Commission, the Department of
   55  Environmental Protection, or the Department of Law Enforcement.
   56         (e)(d) “Public transit employees or agents” means bus
   57  operators, train operators, revenue collectors, security
   58  personnel, equipment maintenance personnel, or field
   59  supervisors, who are employees or agents of a transit agency as
   60  described in s. 812.015(1)(l).
   61         (2) Whenever any person is charged with knowingly
   62  committing an assault or battery upon a law enforcement officer,
   63  a firefighter, an emergency medical care provider, a traffic
   64  accident investigation officer as described in s. 316.640, a
   65  nonsworn law enforcement agency employee who is certified as an
   66  agency inspector, blood alcohol analyst, or a breath test
   67  operator while such employee is in uniform and engaged in
   68  processing, testing, evaluating, analyzing, or transporting a
   69  person who is detained or under arrest for DUI, a law
   70  enforcement explorer performing duties under the direction of a
   71  sworn officer, a traffic infraction enforcement officer as
   72  described in s. 316.640, a parking enforcement specialist as
   73  defined in s. 316.640, a person licensed as a security officer
   74  as defined in s. 493.6101 and wearing a uniform that bears at
   75  least one patch or emblem that is visible at all times that
   76  clearly identifies the employing agency and that clearly
   77  identifies the person as a licensed security officer, or a
   78  security officer employed by the board of trustees of a
   79  community college, while the officer, firefighter, emergency
   80  medical care provider, intake officer, traffic accident
   81  investigation officer, traffic infraction enforcement officer,
   82  inspector, analyst, operator, parking enforcement specialist,
   83  public transit employee or agent, or security officer is engaged
   84  in the lawful performance of his or her duties, the offense for
   85  which the person is charged shall be reclassified as follows:
   86         (a) In the case of assault, from a misdemeanor of the
   87  second degree to a misdemeanor of the first degree.
   88         (b) In the case of battery, from a misdemeanor of the first
   89  degree to a felony of the third degree.
   90         (c) In the case of aggravated assault, from a felony of the
   91  third degree to a felony of the second degree. Notwithstanding
   92  any other provision of law, any person convicted of aggravated
   93  assault upon a law enforcement officer shall be sentenced to a
   94  minimum term of imprisonment of 3 years.
   95         (d) In the case of aggravated battery, from a felony of the
   96  second degree to a felony of the first degree. Notwithstanding
   97  any other provision of law, any person convicted of aggravated
   98  battery of a law enforcement officer shall be sentenced to a
   99  minimum term of imprisonment of 5 years.
  100         Section 2. For the purpose of incorporating the amendment
  101  made by this act to section 784.07, Florida Statutes, in
  102  references thereto, paragraphs (d), (f), and (g) of subsection
  103  (3) of section 921.0022, Florida Statutes, are reenacted to
  104  read:
