    2         An act relating to law enforcement explorers; amending
    3         s. 784.07, F.S.; defining the term “law enforcement
    4         explorer”; providing for reclassification of certain
    5         offenses against law enforcement explorers; reenacting
    6         s. 921.0022(3)(d), (f), and (g), F.S., relating to the
    7         offense severity ranking chart of the Criminal
    8         Punishment Code, to incorporate the amendments made to
    9         s. 784.07, F.S., in references thereto; providing an
   10         effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsections (1) and (2) of section 784.07,
   15  Florida Statutes, are amended to read:
   16         784.07 Assault or battery of law enforcement officers,
   17  firefighters, emergency medical care providers, public transit
   18  employees or agents, or other specified officers;
   19  reclassification of offenses; minimum sentences.—
   20         (1) As used in this section, the term:
   21         (a)(c) “Emergency medical care provider” means an ambulance
   22  driver, emergency medical technician, paramedic, registered
   23  nurse, physician as defined in s. 401.23, medical director as
   24  defined in s. 401.23, or any person authorized by an emergency
   25  medical service licensed under chapter 401 who is engaged in the
   26  performance of his or her duties. The term “emergency medical
   27  care provider” also includes physicians, employees, agents, or
   28  volunteers of hospitals as defined in chapter 395, who are
   29  employed, under contract, or otherwise authorized by a hospital
   30  to perform duties directly associated with the care and
   31  treatment rendered by the hospital’s emergency department or the
   32  security thereof.
   33         (b) “Firefighter” means any person employed by any public
   34  employer of this state whose duty it is to extinguish fires; to
   35  protect life or property; or to enforce municipal, county, and
   36  state fire prevention codes, as well as any law pertaining to
   37  the prevention and control of fires.
   38         (c)“Law enforcement explorer” means any person who is a
   39  current member of a law enforcement agency’s explorer program
   40  and who is performing functions other than those required to be
   41  performed by a sworn law enforcement officer on behalf of a law
   42  enforcement agency while under the direct physical supervision
   43  of a sworn officer of that agency and wearing a uniform that
   44  bears at least one patch that clearly identifies the law
   45  enforcement agency that he or she represents.
   46         (d)(a) “Law enforcement officer” includes a law enforcement
   47  officer, a correctional officer, a correctional probation
   48  officer, a part-time law enforcement officer, a part-time
   49  correctional officer, an auxiliary law enforcement officer, and
   50  an auxiliary correctional officer, as those terms are
   51  respectively defined in s. 943.10, and any county probation
   52  officer; an employee or agent of the Department of Corrections
   53  who supervises or provides services to inmates; an officer of
   54  the Parole Commission; a federal law enforcement officer as
   55  defined in s. 901.1505; and law enforcement personnel of the
   56  Fish and Wildlife Conservation Commission, the Department of
   57  Environmental Protection, or the Department of Law Enforcement.
   58         (e)(d) “Public transit employees or agents” means bus
   59  operators, train operators, revenue collectors, security
   60  personnel, equipment maintenance personnel, or field
   61  supervisors, who are employees or agents of a transit agency as
   62  described in s. 812.015(1)(l).
   63         (2) Whenever any person is charged with knowingly
   64  committing an assault or battery upon a law enforcement officer,
   65  a firefighter, an emergency medical care provider, a traffic
   66  accident investigation officer as described in s. 316.640, a
   67  nonsworn law enforcement agency employee who is certified as an
   68  agency inspector, blood alcohol analyst, or a breath test
   69  operator while such employee is in uniform and engaged in
   70  processing, testing, evaluating, analyzing, or transporting a
   71  person who is detained or under arrest for DUI, a law
   72  enforcement explorer performing duties under the direction of a
   73  sworn officer, a traffic infraction enforcement officer as
   74  described in s. 316.640, a parking enforcement specialist as
   75  defined in s. 316.640, a person licensed as a security officer
   76  as defined in s. 493.6101 and wearing a uniform that bears at
   77  least one patch or emblem that is visible at all times that
   78  clearly identifies the employing agency and that clearly
   79  identifies the person as a licensed security officer, or a
   80  security officer employed by the board of trustees of a
   81  community college, while the officer, firefighter, emergency
   82  medical care provider, intake officer, traffic accident
   83  investigation officer, traffic infraction enforcement officer,
   84  inspector, analyst, operator, parking enforcement specialist,
   85  public transit employee or agent, or security officer is engaged
   86  in the lawful performance of his or her duties, the offense for
   87  which the person is charged shall be reclassified as follows:
   88         (a) In the case of assault, from a misdemeanor of the
   89  second degree to a misdemeanor of the first degree.
   90         (b) In the case of battery, from a misdemeanor of the first
   91  degree to a felony of the third degree.
   92         (c) In the case of aggravated assault, from a felony of the
   93  third degree to a felony of the second degree. Notwithstanding
   94  any other provision of law, any person convicted of aggravated
   95  assault upon a law enforcement officer shall be sentenced to a
   96  minimum term of imprisonment of 3 years.
   97         (d) In the case of aggravated battery, from a felony of the
   98  second degree to a felony of the first degree. Notwithstanding
   99  any other provision of law, any person convicted of aggravated
  100  battery of a law enforcement officer shall be sentenced to a
  101  minimum term of imprisonment of 5 years.
  102         Section 2. For the purpose of incorporating the amendment
  103  made by this act to section 784.07, Florida Statutes, in
  104  references thereto, paragraphs (d), (f), and (g) of subsection
  105  (3) of section 921.0022, Florida Statutes, are reenacted to
  106  read:
