2 An act relating to court costs; amending s. 938.10,
3 F.S.; expanding the list of provisions of law for
4 which a court is required to impose an additional
5 court cost for certain pleadings or findings relating
6 to offenses against a minor and certain other
7 offenses; increasing the amount of the court cost;
8 providing for distribution of a portion of the court
9 costs to the Office of the Statewide Guardian Ad Litem
10 and the Florida Network of Children’s Advocacy
11 Centers, Inc.; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 938.10, Florida Statutes, is amended to
16 read:
17 938.10 Additional court cost imposed in cases of certain
18 crimes against minors.—
19 (1) If a person pleads guilty or nolo contendere to, or is
20 found guilty of, regardless of adjudication, any offense against
21 a minor in violation of s. 784.085, chapter 787, chapter 794, s.
22 796.03, s. 796.035, s. 800.04, chapter 827, s. 847.012, s.
23 847.0133, s. 847.0135(5), s. 847.0138, s. 847.0145, s.
24 893.147(3), or s. 985.701, or any offense in violation of s.
25 775.21, s. 823.07, s. 847.0125, s. 847.0134, or s. 943.0435, the
26 court shall impose a court cost of $151 $101 against the
27 offender in addition to any other cost or penalty required by
28 law.
29 (2) Each month the clerk of the court shall transfer $50
30 from the proceeds of the court cost, less $1 from each sum
31 collected which the clerk shall retain as a service charge, to
32 the Department of Revenue for deposit into the Department of
33 Children and Family Services’ Grants and Donations Trust Fund
34 for disbursement to the Office of the Statewide Guardian Ad
35 Litem and $100 to the Department of Revenue for deposit into the
36 Department of Children and Family Services Grants and Donations
37 Trust Fund for disbursement to the Florida Network of Children’s
38 Advocacy Centers, Inc., for the purpose of funding children’s
39 advocacy centers that are members of the network. The clerk
40 shall retain $1 from each sum collected as a service charge.
41 Section 2. This act shall take effect July 1, 2009.
