10 | plans; authorizing the board to levy taxes for specified |
11 | purposes; providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |
14 |

15 | Section 1. Section 388.296, Florida Statutes, is created |
16 | to read: |
17 | 388.296 Mitigation plans.--The board of commissioners in a |
18 | district containing Outstanding Florida Waters shall, in |
19 | coordination with the department and the appropriate water |
20 | management district, determine if the activities of the district |
21 | have had any adverse effects on such waters. If it is determined |
22 | that adverse effects have occurred as a result of the district's |
23 | activities, the board shall, in consultation with the |
24 | appropriate water management district, develop a plan that the |
25 | board finds to be technically and economically feasible for the |
26 | mitigation of such adverse effects. The mitigation plan shall be |
27 | adopted by the district no later than July 1, 2010, and shall be |
28 | implemented beginning in the district's 2010-2011 fiscal year. |
29 | The board may levy taxes under s. 388.221 for the purposes of |
30 | this section. |
31 | Section 2. This act shall take effect July 1, 2009. |
