A bill to be entitled
2An act relating to mosquito control districts; creating s.
3388.296, F.S.; requiring the board of commissioners in
4mosquito control districts containing Outstanding Florida
5Waters to consult and coordinate with the Department of
6Agriculture and Consumer Services and water management
7districts to determine certain adverse effects and develop
8mitigation plans for such adverse effects; specifying
9dates for the adoption and implementation of mitigation
10plans; authorizing the board to levy taxes for specified
11purposes; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Section 388.296, Florida Statutes, is created
16to read:
17     388.296  Mitigation plans.--The board of commissioners in a
18district containing Outstanding Florida Waters shall, in
19coordination with the department and the appropriate water
20management district, determine if the activities of the district
21have had any adverse effects on such waters. If it is determined
22that adverse effects have occurred as a result of the district's
23activities, the board shall, in consultation with the
24appropriate water management district, develop a plan that the
25board finds to be technically and economically feasible for the
26mitigation of such adverse effects. The mitigation plan shall be
27adopted by the district no later than July 1, 2010, and shall be
28implemented beginning in the district's 2010-2011 fiscal year.
29The board may levy taxes under s. 388.221 for the purposes of
30this section.
31     Section 2.  This act shall take effect July 1, 2009.
