A bill to be entitled
2An act relating to illegal immigration; creating s.
3111.076, F.S.; prohibiting restrictions on the reporting
4of certain immigration status information by public
5employees; creating ss. 125.582 and 166.04935, F.S.;
6prohibiting certain local government restrictions
7concerning communication or cooperation with federal
8officials concerning immigration law enforcement;
9providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Section 111.076, Florida Statutes, is created
14to read:
15     111.076  Reporting of immigration status
16information.--Notwithstanding any other provision of law, an
17agency, as defined in s. 20.03, may not prohibit or in any way
18restrict a public employee from doing any of the following with
19respect to information regarding the immigration status of any
20individual:
21     (1)  Sending such information to, or requesting or
22receiving such information from, the United States Department of
23Homeland Security;
24     (2)  Maintaining such information; or
25     (3)  Exchanging such information with any other federal,
26state, or local governmental entity.
27     Section 2.  Section 125.582, Florida Statutes, is created
28to read:
29     125.582  Communicating or cooperating with federal
30officials concerning immigration.--
31     (1)  A county government, whether acting through its
32governing body or by an initiative, referendum, or any other
33process, may not enact any ordinance or policy that limits or
34prohibits a law enforcement officer, local official, or local
35government employee from communicating or cooperating with
36federal officials with regard to the immigration status of any
37person within this state.
38     (2)  Notwithstanding any other provision of law, a county
39governmental entity or official may not prohibit or in any way
40restrict any governmental entity or government official from
41sending to, or receiving from, the United States Department of
42Homeland Security information regarding the citizenship or
43immigration status of any individual.
44     Section 3.  Section 166.04935, Florida Statutes, is created
45to read:
46     166.04935  Communicating or cooperating with federal
47officials concerning immigration.--
48     (1)  A municipal government, whether acting through its
49governing body or by an initiative, referendum, or any other
50process, may not enact any ordinance or policy that limits or
51prohibits a law enforcement officer, local official, or local
52government employee from communicating or cooperating with
53federal officials with regard to the immigration status of any
54person within this state.
55     (2)  Notwithstanding any other provision of law, a
56municipal governmental entity or official may not prohibit or in
57any way restrict any governmental entity or government official
58from sending to, or receiving from, the United States Department
59of Homeland Security information regarding the citizenship or
60immigration status of any individual.
61     Section 4.  This act shall take effect July 1, 2009.
