Subsection (26) of section 334.044, Florida 7 Statutes, is amended to read: 8 334.044 Department; powers and duties.—The department shall 9 have the following general powers and duties: 10 (26) To provide for the enhancement of environmental 11 benefits, including air and water quality, to prevent roadside 12 erosion, to conserve theconservation ofnatural roadside growth 13 and scenery and for the implementation and maintenance of 14 roadside conservation, enhancement, and stabilization 15beautificationprograms, and no less than 1.5 percent of the 16 amount contracted for construction projects shall be allocated 17 by the department tobeautification programs. Except where18prohibited by federal law or federal regulation and tothe 19 greatest extent practical, a minimum of 50 percent of these 20 funds shall be used to purchase large plant materials with the 21 remaining funds for other plant materials. All such plant 22 materials shall be purchased from commercial nurseryFlorida23based nurserymanstock in this state on a uniform competitive 24 bid basis. The department will develop grades and standards for 25 landscaping materials purchased through this process.
