       Senators Baker and Bullard moved the following:
       
    1         Senate Substitute for Amendment (454474) (with title

    5  insert:
    6         Section 9. Subsection (26) of section 334.044, Florida
    7  Statutes, is amended to read:
    8         334.044 Department; powers and duties.—The department shall
    9  have the following general powers and duties:
   10         (26) To provide for the enhancement of environmental
   11  benefits, including air and water quality, to prevent roadside
   12  erosion, to conserve the conservation of natural roadside growth
   13  and scenery and for the implementation and maintenance of
   14  roadside conservation, enhancement, and stabilization
   15  beautification programs, and no less than 1.5 percent of the
   16  amount contracted for construction projects shall be allocated
   17  by the department to beautification programs. Except where
   18  prohibited by federal law or federal regulation and to the
   19  greatest extent practical, a minimum of 50 percent of these
   20  funds shall be used to purchase large plant materials with the
   21  remaining funds for other plant materials. All such plant
   22  materials shall be purchased from commercial nursery Florida
   23  based nurseryman stock in this state on a uniform competitive
   24  bid basis. The department will develop grades and standards for
   25  landscaping materials purchased through this process. To
   26  accomplish these activities, the department may contract with
   27  nonprofit organizations having the primary purpose of developing
   28  youth employment opportunities.
