       Senator Baker moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 99 and 100
    4  insert:
    5         Section 3. Subsection (5) of section 316.535, Florida
    6  Statutes, is amended to read:
    7         316.535 Maximum weights.—
    8         (5) With respect to those highways not in the Interstate
    9  Highway System, in all cases in which it exceeds state law in
   10  effect on January 4, 1975, the overall gross weight on the
   11  vehicle or combination of vehicles, including all enforcement
   12  tolerances, shall be as determined by the following formula:
   13  
   14         W = 500((LN ÷ (N–1)) + 12N + 36)
   15  
   16         where W = overall gross weight of the vehicle to the
   17  nearest 500 pounds; L = distance in feet between the extreme of
   18  the external axles; and N = number of axles on the vehicle.
   19  However, such overall gross weight of any vehicle or combination
   20  of vehicles may not exceed 80,000 pounds including all
   21  enforcement tolerances. The scale tolerance provided in s.
   22  316.545(2) shall be applicable to all weight limitations of this
   23  subsection. Except when a vehicle exceeds the posted weight
   24  limit on a bridge, fines for violations of the total gross
   25  weight limitations provided for in this subsection shall be
   26  based on the amount by which the actual weight of the vehicle
   27  and load exceeds the allowable maximum weight determined under
   28  this subsection plus the scale tolerance provided in s.
   29  316.545(2).
   30         Section 4. Subsection (2) of section 337.0261, Florida
   31  Statutes, is amended to read:
   32         337.0261 Construction aggregate materials.—
   33         (2) LEGISLATIVE INTENT.—The Legislature finds that there is
   34  a strategic and critical need for an available supply of
   35  construction aggregate materials within the state and that a
   36  disruption of the supply would cause a significant detriment to
   37  the state’s construction industry, transportation system, and
   38  overall health, safety, and welfare. In addition, the
   39  Legislature recognizes that construction aggregate materials
   40  mining is an industry of critical importance to the state and
   41  that the mining of construction aggregate materials is in the
   42  public interest.
   43         Section 5. Subsections (1) and (4) of section 339.2818,
   44  Florida Statutes, are amended to read:
   45         339.2818 Small County Outreach Program.—
   46         (1) There is created within the Department of
   47  Transportation the Small County Outreach Program. The purpose of
   48  this program is to assist small county governments in repairing
   49  or rehabilitating county bridges, paving unpaved roads,
   50  addressing road-related drainage improvements, resurfacing or
   51  reconstructing county roads or in constructing capacity or
   52  safety improvements to county roads.
   53         (4)(a) Small counties shall be eligible to compete for
   54  funds that have been designated for the Small County Outreach
   55  Program for projects on county roads. The department shall fund
   56  75 percent of the cost of projects on county roads funded under
   57  the program.
   58         (b) In determining a county’s eligibility for assistance
   59  under this program, the department may consider whether the
   60  county has attempted to keep county roads in satisfactory
   61  condition which may be evidenced through an established pavement
   62  management plan.
   63         (c) The following criteria shall be used to prioritize road
   64  projects for funding under the program:
   65         1. The primary criterion is the physical condition of the
   66  road as measured by the department.
   67         2. As secondary criteria the department may consider:
   68         a. Whether a road is used as an evacuation route.
   69         b. Whether a road has high levels of agricultural travel.
   70         c. Whether a road is considered a major arterial route.
   71         d. Whether a road is considered a feeder road.
   72         e. Information as evidenced to the department through an
   73  established pavement management plan
   74         f.e. Other criteria related to the impact of a project on
   75  the public road system or on the state or local economy as
   76  determined by the department.

   79         And the title is amended as follows:

   81  insert:
   82         amending s. 316.535, F.S.; requiring specified scale
   83  tolerances to be applied to weight limits for vehicles on
   84  highways that are not in the Interstate Highway System; amending
   85  s. 337.0261, F.S.; recognizing that construction aggregate
   86  materials mining is an industry of critical importance and that
   87  the mining of construction aggregate materials is in the public
   88  interest; amending s. 339.2818, F.S., relating to the Small
   89  County Outreach Program; revising the purpose of the program to
   90  include certain program types; revising eligibility and
   91  prioritization criteria;
