Subsection (26) of section 334.044, Florida 6 Statutes, is amended to read: 7 334.044 Department; powers and duties.—The department shall 8 have the following general powers and duties: 9 (26) To provide for the enhancement of environmental 10 benefits, including air and water quality, to prevent roadside 11 erosion, to conserve theconservation ofnatural roadside growth 12 and scenery and for the implementation and maintenance of 13 roadside conservation, enhancement, and stabilization 14beautificationprograms, and no less than 1.5 percent of the 15 amount contracted for construction projects shall be allocated 16 by the department tobeautification programs. Except where17prohibited by federal law or federal regulation and tothe 18 greatest extent practical, a minimum of 50 percent of these 19 funds shall be used to purchase large plant materials with the 20 remaining funds for other plant materials. All such plant 21 materials shall be purchased from commercial nurseryFlorida22based nurserymanstock in this state on a uniform competitive 23 bid basis. The department will develop grades and standards for 24 landscaping materials purchased through this process. To 25 accomplish these activities, the department may contract with 26 nonprofit organizations having the primary purpose of developing 27 youth employment opportunities. 28 29 ================= T I T L E A M E N D M E N T ================ 30 And the title is amended as follows: 31 Delete line 48 32 and insert: 33 functional at all times; amending s. 334.044, F.S.; 34 revising the powers and duties of the Department of 35 Transportation; amending s. 339.62, F.S.;
