       Senator Baker moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 99 and 100
    4  insert:
    5         Section 3. Subsection (1) of section 338.01, Florida
    6  Statutes, is amended to read:
    7         338.01 Authority to establish and regulate limited access
    8  facilities.—
    9         (1) The transportation and expressway authorities of the
   10  state, counties, and municipalities, referred to in this chapter
   11  as “authorities,” acting alone or in cooperation with each other
   12  or with any federal, state, or local governmental entity or
   13  agency of any other state that is authorized to construct
   14  highways, are authorized to provide limited access facilities
   15  for public use. Any of the authorities may construct a limited
   16  access highway as a new facility or may designate an existing
   17  street or highway as included within a limited access facility.
   18  However:,
   19         1. If the limited access facility is entirely located
   20  within an incorporated municipality, such authority is subject
   21  to municipal consent; except that such consent is not necessary
   22  when such limited access facility is part of the interstate
   23  system.
   24         2. Neither the construction of a new toll facility nor the
   25  imposition of a toll on an existing state highway system
   26  facility may eliminate a non-tolled alternative within the
   27  corridor serving similar origins and destinations.

   31         Between lines 18 and 19
   32  insert:
   33  amending s. 338.01, F.S.; prohibiting new toll facilities from
   34  eliminating non-tolled options for travel in the same corridor;
