    1                        A bill to be entitled                      
    2         An act relating to termination of pregnancy; amending
    3         s. 390.01114, F.S.; prohibiting a nonresident minor
    4         from petitioning a circuit court in this state for
    5         judicial waiver of notice of termination of pregnancy;
    6         providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9         
   10         Section 1. Paragraph (a) of subsection (4) of section
   11  390.01114, Florida Statutes, is amended to read:
   12         390.01114 Parental Notice of Abortion Act.—
   13         (4) PROCEDURE FOR JUDICIAL WAIVER OF NOTICE.—
   14         (a) A minor may petition any circuit court in a judicial
   15  circuit within the jurisdiction of the District Court of Appeal
   16  in which she resides for a waiver of the notice requirements of
   17  subsection (3) and may participate in proceedings on her own
   18  behalf. The petition may be filed under a pseudonym or through
   19  the use of initials, as provided by court rule. The petition
   20  must include a statement that the petitioner is pregnant and
   21  notice has not been waived. The court shall advise the minor
   22  that she has a right to court-appointed counsel and shall
   23  provide her with counsel upon her request at no cost to the
   24  minor. A nonresident minor may not petition any circuit court of
   25  this state for a waiver of the notice requirements of subsection
   26  (3).
   27         Section 2. This act shall take effect July 1, 2009.
