A bill to be entitled
2An act relating to school bus stops; amending s. 1006.22,
3F.S.; prohibiting school bus stops from being located
4directly on certain state-maintained roads; providing for
5phased-in implementation; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Paragraph (c) of subsection (12) of section
101006.22, Florida Statutes, is amended to read:
11     1006.22  Safety and health of students being
12transported.--Maximum regard for safety and adequate protection
13of health are primary requirements that must be observed by
14district school boards in routing buses, appointing drivers, and
15providing and operating equipment, in accordance with all
16requirements of law and rules of the State Board of Education in
17providing transportation pursuant to s. 1006.21:

19     (c)1.  Each district school board shall establish school
20bus stops, or provide by district school board rule for the
21establishment of school bus stops, as necessary at the most
22reasonably safe locations available. Where unusual traffic
23hazards exist at school bus stops on roads maintained by the
24state outside of municipalities, the Department of
25Transportation, in concurrence and cooperation with and upon
26request of the district school board, shall place signs at such
27bus stops warning motorists of the location of the stops.
28     2.  To provide safe locations for school bus stops for the
29loading and unloading of students, beginning July 1, 2009, a new
30school bus stop may not be established directly on a state-
31maintained road with a speed limit of 55 miles per hour or
32greater.
33     3.  To improve the safety of existing locations for school
34bus stops for the loading and unloading of students, beginning
35with the 2011-2012 school year, a school bus stop may not be
36located directly on a state-maintained road with a speed limit
37of 55 miles per hour or greater.
38     Section 2.  This act shall take effect July 1, 2009.
