7 | Be It Enacted by the Legislature of the State of Florida: |

9 | Section 1. Paragraph (c) of subsection (12) of section |
10 | 1006.22, Florida Statutes, is amended to read: |
11 | 1006.22 Safety and health of students being |
12 | transported.--Maximum regard for safety and adequate protection |
13 | of health are primary requirements that must be observed by |
14 | district school boards in routing buses, appointing drivers, and |
15 | providing and operating equipment, in accordance with all |
16 | requirements of law and rules of the State Board of Education in |
17 | providing transportation pursuant to s. 1006.21: |

19 | (c)1. Each district school board shall establish school |
20 | bus stops, or provide by district school board rule for the |
21 | establishment of school bus stops, as necessary at the most |
22 | reasonably safe locations available. Where unusual traffic |
23 | hazards exist at school bus stops on roads maintained by the |
24 | state outside of municipalities, the Department of |
25 | Transportation, in concurrence and cooperation with and upon |
26 | request of the district school board, shall place signs at such |
27 | bus stops warning motorists of the location of the stops. |
28 | 2. To provide safe locations for school bus stops for the |
29 | loading and unloading of students, beginning July 1, 2009, a new |
30 | school bus stop may not be established directly on a state- |
31 | maintained road with a speed limit of 55 miles per hour or |
32 | greater. |
33 | 3. To improve the safety of existing locations for school |
34 | bus stops for the loading and unloading of students, beginning |
35 | with the 2011-2012 school year, a school bus stop may not be |
36 | located directly on a state-maintained road with a speed limit |
37 | of 55 miles per hour or greater. |
38 | Section 2. This act shall take effect July 1, 2009. |
