Paragraphs (qqq) and (rrr) are added to 6 subsection (4) of section 320.08056, Florida Statutes, to read: 7 320.08056 Specialty license plates.— 8 (4) The following license plate annual use fees shall be 9 collected for the appropriate specialty license plates: 10 (qqq) Autism license plate, $25. 11 (rrr) Toomey Foundation for the Natural Sciences license 12 plate, $25. 13 Section 2. Subsections (69) and (70) are added to section 14 320.08058, Florida Statutes, to read: 15 320.08058 Specialty license plates.— 16 (69) AUTISM LICENSE PLATES.— 17 (a) The department shall develop an Autism license plate as 18 provided in this section. Autism license plates must bear the 19 colors and design approved by the department. The word “Florida” 20 must appear at the top of the plate, and the words “Support 21 Autism Programs” must appear at the bottom of the plate. 22 (b) The proceeds from the license plate annual use fee 23 shall be distributed to Achievement and Rehabilitation Centers, 24 Inc., to fund service programs for autism and related 25 disabilities throughout the state and to operate and establish 26 programs to support individuals with autism and related 27 disabilities through direct services, evaluation, training, and 28 awareness. Achievement and Rehabilitation Centers, Inc., shall 29 establish an Autism Services Grant Council that shall provide 30 grants from available Autism license plate proceeds to nonprofit 31 organizations for direct services and programs for individuals 32 with autism and related disabilities and their families. 33 Consideration for participation in such services and programs 34 shall be given to applicants who are children or adults with 35 autism and related disabilities and their families and shall 36 include those who are on the Agency for Persons with 37 Disabilities waiting lists for services. Achievement and 38 Rehabilitation Centers, Inc., shall also establish an Autism 39 License Plate Fund. Moneys in the fund shall be used by the 40 grant council as provided in this paragraph. All funds received 41 under this subsection must be used in this state. 42 (c) Achievement and Rehabilitation Centers, Inc., may 43 retain all proceeds from the annual use fee up to $85,000 until 44 all documented startup costs for developing and establishing the 45 plate have been recovered. Thereafter, the proceeds from the 46 annual use fee shall be used as follows: 47 1. Up to 15 percent of the proceeds from the annual use fee 48 may be used for the administration of the Autism License Plate 49 Fund, the Autism Services Grant Council, and related matters. 50 2. Funds may be used as necessary for annual audit or 51 compliance affidavit costs. 52 3. Thirty-five percent of the proceeds from the annual use 53 fee shall be used to establish and operate programs to support 54 individuals with autism and related disabilities and their 55 families through direct services, evaluation, training, and 56 awareness in the state. 57 4. The Center for Autism and Related Disabilities at the 58 University of Miami shall receive 15 percent of the proceeds 59 from the annual use fee for distribution, as determined 60 appropriate by the director of that center, to the seven 61 regional autism centers created under s. 1004.55. The regional 62 centers shall use the proceeds to support the services they 63 provide. 64 5. The remaining proceeds from the annual use fee shall be 65 available to the Autism Services Grant Council for grants to 66 nonprofit organizations to operate direct services programs for 67 individuals with autism and related disabilities and their 68 families and for marketing the Autism license plate. All grant 69 recipients, including Achievement and Rehabilitation Centers, 70 Inc., and the Center for Autism and Related Disabilities, shall 71 be required to provide to the Autism Services Grant Council an 72 annual program and financial report regarding the use of grant 73 funds. Such reports shall be made available to the public. 74 (70) TOOMEY FOUNDATION FOR THE NATURAL SCIENCES LICENSE 75 PLATES.— 76 (a) The department shall develop a Toomey Foundation for 77 the Natural Sciences license plate as provided in this section. 78 The plate must bear the colors and design approved by the 79 department. The word “Florida” must appear at the top of the 80 plate, and the words “Preserving the Past” must appear at the 81 bottom of the plate. 82 (b) The annual use fees shall be distributed to the Toomey 83 Foundation for the Natural Sciences, Inc., which shall retain 50 84 percent of the proceeds until the startup costs to develop and 85 establish the plates have been recovered. Thereafter, the 86 proceeds shall be used as follows: 87 1. A maximum of 25 percent of the proceeds may be used to 88 fund the administrative, promotion, and marketing costs of the 89 license plate program and the foundation. 90 2. The remaining fees shall be used by the foundation to 91 acquire, manage, and preserve properties that are of scientific 92 importance to paleontologists, archeologists, or geologists for 93 the purposes of research and education and to promote and 94 protect the unique natural sciences of this state. 95 96 97 ================= T I T L E A M E N D M E N T ================ 98 And the title is amended as follows: 99 Delete line 4 100 and insert: 101 F.S.; creating an Autism license plate and a Toomey 102 Foundation for the Natural Sciences license plate; 103 establishing
