Paragraphs (qqq) and (rrr) are added to 6 subsection (4) of section 320.08056, Florida Statutes, to read: 7 320.08056 Specialty license plates.— 8 (4) The following license plate annual use fees shall be 9 collected for the appropriate specialty license plates: 10 (qqq) Autism license plate, $25. 11 (rrr) Trinity license plate, $25. 12 Section 3. Subsections (69) and (70) are added to section 13 320.08058, Florida Statutes, to read: 14 320.08058 Specialty license plates.— 15 (69) AUTISM LICENSE PLATES.— 16 (a) The department shall develop an Autism license plate as 17 provided in this section. Autism license plates must bear the 18 colors and design approved by the department. The word “Florida” 19 must appear at the top of the plate, and the words “Support 20 Autism Programs” must appear at the bottom of the plate. 21 (b) The proceeds from the license plate annual use fee 22 shall be distributed to Achievement and Rehabilitation Centers, 23 Inc., to fund service programs for autism and related 24 disabilities throughout the state and to operate and establish 25 programs to support individuals with autism and related 26 disabilities through direct services, evaluation, training, and 27 awareness. Achievement and Rehabilitation Centers, Inc., shall 28 establish an Autism Services Grant Council that shall provide 29 grants from available Autism license plate proceeds to nonprofit 30 organizations for direct services and programs for individuals 31 with autism and related disabilities and their families. 32 Consideration for participation in such services and programs 33 shall be given to applicants who are children or adults with 34 autism and related disabilities and their families and shall 35 include those who are on the Agency for Persons with 36 Disabilities waiting lists for services. Achievement and 37 Rehabilitation Centers, Inc., shall also establish an Autism 38 License Plate Fund. Moneys in the fund shall be used by the 39 grant council as provided in this paragraph. All funds received 40 under this subsection must be used in this state. 41 (c) Achievement and Rehabilitation Centers, Inc., may 42 retain all proceeds from the annual use fee up to $85,000 until 43 all documented startup costs for developing and establishing the 44 plate have been recovered. Thereafter, the proceeds from the 45 annual use fee shall be used as follows: 46 1. Up to 15 percent of the proceeds from the annual use fee 47 may be used for the administration of the Autism License Plate 48 Fund, the Autism Services Grant Council, and related matters. 49 2. Funds may be used as necessary for annual audit or 50 compliance affidavit costs. 51 3. Thirty-five percent of the proceeds from the annual use 52 fee shall be used to establish and operate programs to support 53 individuals with autism and related disabilities and their 54 families through direct services, evaluation, training, and 55 awareness in the state. 56 4. The Center for Autism and Related Disabilities at the 57 University of Miami shall receive 15 percent of the proceeds 58 from the annual use fee for distribution, as determined 59 appropriate by the director of that center, to the seven 60 regional autism centers created under s. 1004.55. The regional 61 centers shall use the proceeds to support the services they 62 provide. 63 5. The remaining proceeds from the annual use fee shall be 64 available to the Autism Services Grant Council for grants to 65 nonprofit organizations to operate direct services programs for 66 individuals with autism and related disabilities and their 67 families and for marketing the Autism license plate. All grant 68 recipients, including Achievement and Rehabilitation Centers, 69 Inc., and the Center for Autism and Related Disabilities, shall 70 be required to provide to the Autism Services Grant Council an 71 annual program and financial report regarding the use of grant 72 funds. Such reports shall be made available to the public. 73 (70) TRINITY LICENSE PLATES.— 74 (a) The department shall develop a Trinity license plate as 75 provided in this section. The plate must bear the colors and 76 design approved by the department. The word “Florida” must 77 appear at the top of the plate and the words “Sunshine State” 78 must appear at the bottom of the plate. 79 (b) The annual use fees shall be distributed to the Toomey 80 Foundation for the Natural Sciences, Inc., which shall retain 50 81 percent of the proceeds until the startup costs to develop and 82 establish the plates have been recovered. Thereafter, the 83 proceeds shall be used as follows: 84 1. A maximum of 25 percent of the proceeds may be used to 85 fund the administrative, promotion, and marketing costs of the 86 license plate program and the foundation. 87 2. The remaining fees shall be used by the foundation to 88 support educational, research, and scientific activities in this 89 state, including the distribution of funds to qualified entities 90 in furtherance of the stated purposes of the foundation. 91 92 ================= T I T L E A M E N D M E N T ================ 93 And the title is amended as follows: 94 Delete line 4 95 and insert: 96 F.S.; creating an Autism license plate and a Trinity 97 license plate; establishing
