| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |

| 13 | Section 1. Section 290.00725, Florida Statutes, is created |
| 14 | to read: |
| 15 | 290.00725 Enterprise zone designation for Martin |
| 16 | County.--Martin County may apply to the Office of Tourism, |
| 17 | Trade, and Economic Development for designation of one |
| 18 | enterprise zone for an area within Martin County, which zone |
| 19 | shall encompass an area up to 10 square miles consisting of land |
| 20 | within the primary urban services boundary and focusing on |
| 21 | Indiantown, but excluding property owned by Florida Power and |
| 22 | Light to the west, two areas to the north designated as estate |
| 23 | residential, and the county-owned Timer Powers Recreational |
| 24 | Area. Within the designated enterprise zone, Martin County shall |
| 25 | exempt residential condominiums from benefiting from state |
| 26 | enterprise zone incentives, unless prohibited by law. The |
| 27 | application must be submitted by December 31, 2009, and must |
| 28 | comply with the requirements of s. 290.0055. Notwithstanding s. |
| 29 | 290.0065 limiting the total number of enterprise zones |
| 30 | designated and the number of enterprise zones within a |
| 31 | population category, the Office of Tourism, Trade, and Economic |
| 32 | Development may designate one enterprise zone under this |
| 33 | section. The Office of Tourism, Trade, and Economic Development |
| 34 | shall establish the initial effective date of the enterprise |
| 35 | zone designated pursuant to this section. |
| 36 | Section 2. This act shall take effect July 1, 2009. |
