2An act relating to enterprise zones; creating s.
3290.00725, F.S.; authorizing Martin County to apply to the
4Office of Tourism, Trade, and Economic Development for
5designation of an enterprise zone; providing application
6requirements; authorizing the office to designate an
7enterprise zone in Martin County; providing
8responsibilities of the office; providing an effective
9date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Section 290.00725, Florida Statutes, is created
14to read:
15     290.00725  Enterprise zone designation for Martin
16County.--Martin County may apply to the Office of Tourism,
17Trade, and Economic Development for designation of one
18enterprise zone for an area within Martin County, which zone
19shall encompass an area up to 10 square miles consisting of land
20within the primary urban services boundary and focusing on
21Indiantown, but excluding property owned by Florida Power and
22Light to the west, two areas to the north designated as estate
23residential, and the county-owned Timer Powers Recreational
24Area. Within the designated enterprise zone, Martin County shall
25exempt residential condominiums from benefiting from state
26enterprise zone incentives, unless prohibited by law. The
27application must be submitted by December 31, 2009, and must
28comply with the requirements of s. 290.0055. Notwithstanding s.
29290.0065 limiting the total number of enterprise zones
30designated and the number of enterprise zones within a
31population category, the Office of Tourism, Trade, and Economic
32Development may designate one enterprise zone under this
33section. The Office of Tourism, Trade, and Economic Development
34shall establish the initial effective date of the enterprise
35zone designated pursuant to this section.
36     Section 2.  This act shall take effect July 1, 2009.
