       The Committee on Transportation (Bullard) recommended the
       following:
       
    1         Senate Amendment to Amendment (736630) (with title
    2  amendment)
    3  
    4         After line 72
    5  insert:
    6         Section 10. 
    7         SW 67th Avenue (Ludlam Road) in the City of South Miami and
    8  the Village of Pinecrest in Miami-Dade County from Bird Road to
    9  SW 136th Street is hereby designated as a state historic road.
   10  No public funds shall be expended for any of the following
   11  purposes:
   12         1) To cut or remove any tree having a diameter at its
   13  thickest part in excess of six inches within thirty-five feet of
   14  either side of the paved surface of the road, or to engage in an
   15  activity which requires the removal without the replacement of
   16  such tree.
   17         2) The alteration of the physical dimensions or location of
   18  SW 67th Avenue, the median strip thereof, or the land adjacent
   19  thereto except:
   20         	a) The routine or emergency utilities maintenance
   21  activities necessitated to maintain the road as a utility
   22  corridor.
   23         	b) The modification or improvements made to provide
   24  for vehicular ingress and egress of governmental safety
   25  vehicles.
   26         	c) Alterations, modifications, or improvements made
   27  for the purpose of enhancing life safety vehicular use or
   28  pedestrian use of SW 67th Avenue, or both as long as such
   29  alterations, modifications, or improvements are heard in a
   30  public hearing and subsequently approved by the governing board
   31  of the local government in which it is located.

   33  Nothing in this section shall be construed to prevent the
   34  ordinary maintenance and repair of the road or structures,
   35  provided the physical dimensions and location of the road and
   36  the appearance of any structure are preserved. However, the
   37  preservation of the road shall take priority over considerations
   38  of traffic management, and the public safety shall not be
   39  construed to require alterations in the road when alternative
   40  means promoting safety, including more restrictive traffic
   41  regulations, are available.
   42  Section 11.
   43         The Division of Historical Resources of the Department of
   44  State shall provide for the erection of suitable markers on and
   45  along that portion of SW 67th Avenue described in Section 10 of
   46  this act.

   51  and insert:
   52  Department of Transportation to erect suitable markers;
   53  designating a specified portion of SW 67th Avenue in the City of
   54  South Miami and the Village of Pinecrest in Miami-Dade County as
   55  a state historic road; prohibiting the expenditure of public
   56  funds for certain purposes; providing construction of the act,
   57  directing the Division of Historical Resources of the Department
   58  of State to provide for the erection of suitable markers;
