Love Memorial 17 Highway in Marion County; directing the Department of 18 Transportation to erect suitable markers; designating 19 the Ray Charles Memorial Parkway in Madison County; 20 directing the Department of Transportation to erect 21 suitable markers; designating the Frank Pasquarella 22 Way in Miami-Dade County; directing the Department of 23 Transportation to erect suitable markers; designating 24 a specified portion of Southwest 67th Avenue in the 25 City of South Miami and the Village of Pinecrest in 26 Miami-Dade County as a state historic road; 27 prohibiting the expenditure of public funds for 28 certain purposes; providing construction; directing 29 the Division of Historical Resources of the Department 30 of State to provide for the erection of suitable 31 markers; providing an effective date. 32 33 Be It Enacted by the Legislature of the State of Florida: 34 35 Section 1. Stan Mayfield Memorial Highway designated; 36 Department of Transportation to erect suitable markers.— 37 (1) The portion of State Road 60 beginning directly west of 38 the Interstate 95 interchange in Indian River County and ending 39 at State Road 441 in Osceola County is designated as the “Stan 40 Mayfield Memorial Highway.” 41 (2) The Department of Transportation is directed to erect 42 suitable markers designating the Stan Mayfield Memorial Highway 43 as described in subsection (1). 44 Section 2. Kenneth H. “Buddy” MacKay and Jim H. Williams 45 Memorial Bridge designated; Department of Transportation to 46 erect suitable markers.— 47 (1) The overpass on State Road 464/SW 17th Street in Ocala 48 from SW 12th Avenue to U.S. Highway 27/301/441, State Road 49 25/500, SE Pine Avenue in Marion County is designated as the 50 “Kenneth H. “Buddy” MacKay and Jim H. Williams Memorial Bridge.” 51 (2) The Department of Transportation is directed to erect 52 suitable markers designating the Kenneth H. “Buddy” MacKay and 53 Jim H. Williams Memorial Bridge as described in subsection (1). 54 Section 3. Trooper Ronald Gordon Smith Memorial Bridge 55 designated; Department of Transportation to erect suitable 56 markers.— 57 (1) The bridge on U.S. Highway 19/98 in Citrus County at 58 the Cross Florida Barge Canal is designated as the “Trooper 59 Ronald Gordon Smith Memorial Bridge.” 60 (2) The Department of Transportation is directed to erect 61 suitable markers designating the Trooper Ronald Gordon Smith 62 Memorial Bridge as described in subsection (1). 63 Section 4. Coach Jermaine D. Hall Memorial Highway 64 designated; Department of Transportation to erect suitable 65 markers.— 66 (1) The portion of I-95 between Baymeadows Road and State 67 Road 16 in Duval County is designated as the “Coach Jermaine D. 68 Hall Memorial Highway.” 69 (2) The Department of Transportation is directed to erect 70 suitable markers designating the Coach Jermaine D. Hall Memorial 71 Highway as described in subsection (1). 72 Section 5. Orange Bowl Way designated; Department of 73 Transportation to erect suitable markers.— 74 (1) Northwest 77th Court in Miami Lakes is designated as 75 “Orange Bowl Way.” 76 (2) The Department of Transportation is directed to erect 77 suitable markers designating Orange Bowl Way as described in 78 subsection (1). 79 Section 6. Andrew J. Capeletti Memorial Bridge designated; 80 Department of Transportation to erect suitable markers.— 81 (1) The ramp that connects Northbound Turnpike to 82 Northbound I-75 in Miami-Dade County is designated as the 83 “Andrew J. Capeletti Memorial Bridge.” 84 (2) The Department of Transportation is directed to erect 85 suitable markers designating the Andrew J. Capeletti Memorial 86 Bridge as described in subsection (1). 87 Section 7. Johnny C. Treadwell Highway designated; 88 Department of Transportation to erect suitable markers.— 89 (1) The portion of State Road 46 in Lake County between 90 South Round Lake Road and County Road 435 is designated as the 91 “Johnny C. Treadwell Highway.” 92 (2) The Department of Transportation is directed to erect 93 suitable markers designating the Johnny C. Treadwell Highway as 94 described in subsection (1). 95 Section 8. John Bruce Sweeny Street designated; Department 96 of Transportation to erect suitable markers.— 97 (1) The portion of Herada Street in St. Augustine, in St. 98 Johns County between Menendez Road and Carver Street W is 99 designated as “John Bruce Sweeny Street.” 100 (2) The Department of Transportation is directed to erect 101 suitable markers designating John Bruce Sweeny Street as 102 described in subsection (1). 103 Section 9. Heather Hurd Memorial Highway designated; 104 Department of Transportation to erect suitable markers.— 105 (1) The portion of U.S. Highway 27 in Polk County between 106 Sand Mine Road and U.S. Highway 192 is designated as the 107 “Heather Hurd Memorial Highway.” 108 (2) The Department of Transportation is directed to erect 109 suitable markers designating the Heather Hurd Memorial Highway 110 as described in subsection (1). 111 Section 10. Trooper Charles Eugene Campbell Memorial 112 Highway designated; Department of Transportation to erect 113 suitable markers.— 114 (1) The portion of U.S. Highway 19 north of Perry between 115 Slaughter Road and Harrison Blue Boulevard is designated as the 116 “Trooper Charles Eugene Campbell Memorial Highway.” 117 (2) The Department of Transportation is directed to erect 118 suitable markers designating the Trooper Charles Eugene Campbell 119 Memorial Highway as described in subsection (1). 120 Section 11. Samuel B. Love Memorial Highway designated; 121 Department of Transportation to erect suitable markers.— 122 (1) The portion of Sunset Harbor Road between Southeast 123 105th Avenue and Southeast 115th Avenue in Marion County is 124 designated as the “Samuel B. Love Memorial Highway.” 125 (2) The Department of Transportation is directed to erect 126 suitable markers designating the Samuel B. Love Memorial Highway 127 as described in subsection (1). 128 Section 12. Ray Charles Memorial Parkway designated; 129 Department of Transportation to erect suitable markers.— 130 (1) The portion of U.S. Highway 90 within Greenville in 131 Madison County is designated as the “Ray Charles Memorial 132 Parkway.” 133 (2) The Department of Transportation is directed to erect 134 suitable markers designating the Ray Charles Memorial Parkway as 135 described in subsection (1). 136 Section 13. Frank Pasquarella Way designated; Department of 137 Transportation to erect suitable markers.— 138 (1) The portion of Byrd Road/Southwest 40th Street between 139 Southwest 89th Avenue and Southwest 92nd Avenue in Miami-Dade 140 County is designated as “Frank Pasquarella Way.” 141 (2) The Department of Transportation is directed to erect 142 suitable markers designating the Frank Pasquarella Way as 143 described in subsection (1). 144 Section 14. Ludlam Road designated as a state historic 145 road; limitations on the use of public funds.— 146 (1) Southwest 67th Avenue (Ludlam Road) in the City of 147 South Miami and the Village of Pinecrest in Miami-Dade County 148 from Bird Road to Southwest 136th Street is designated as a 149 state historic road. No public funds shall be expended for any 150 of the following purposes: 151 (a) To cut or remove any tree having a diameter at its 152 thickest part in excess of 6 inches within 35 feet of either 153 side of the paved surface of the road, or to engage in an 154 activity that requires the removal without the replacement of 155 such tree. 156 (b) The alteration of the physical dimensions or location 157 of Southwest 67th Avenue, the median strip thereof, or the land 158 adjacent thereto except: 159 1. The routine or emergency utilities maintenance 160 activities necessitated to maintain the road as a utility 161 corridor. 162 2. The modification or improvements made to provide for 163 vehicular ingress and egress of governmental safety vehicles. 164 3. Alterations, modifications, or improvements made for the 165 purpose of enhancing life safety vehicular use or pedestrian use 166 of Southwest 67th Avenue, or both as long as such alterations, 167 modifications, or improvements are heard in a public hearing and 168 subsequently approved by the governing board of the local 169 government in which it is located. 170 171 Nothing in this section shall be construed to prevent the 172 ordinary maintenance and repair of the road or structures, 173 provided the physical dimensions and location of the road and 174 the appearance of any structure are preserved. However, the 175 preservation of the road shall take priority over considerations 176 of traffic management, and the public safety shall not be 177 construed to require alterations in the road when alternative 178 means promoting safety, including more restrictive traffic 179 regulations, are available. 180 (2) The Division of Historical Resources of the Department 181 of State shall provide for the erection of suitable markers on 182 and along that portion of Southwest 67th Avenue described this 183 in subsection (1). 184 Section 15. This act shall take effect July 1, 2009.
