Earl Durden Highway; 31 designating a specified portion of Southwest 67th 32 Avenue in the City of South Miami and the Village of 33 Pinecrest in Miami-Dade County as a state historic 34 road; directing the Department of Transportation to 35 erect suitable markers; prohibiting the expenditure of 36 public funds for certain purposes; providing 37 construction; directing the Department of 38 Transportation to provide for the erection of suitable 39 markers; providing an effective date. 40 41 Be It Enacted by the Legislature of the State of Florida: 42 43 Section 1. Stan Mayfield Memorial Highway designated; 44 Department of Transportation to erect suitable markers.— 45 (1) The portion of State Road 60 beginning directly west of 46 the Interstate 95 interchange in Indian River County and ending 47 at State Road 441 in Osceola County is designated as the “Stan 48 Mayfield Memorial Highway.” 49 (2) The Department of Transportation is directed to erect 50 suitable markers designating the Stan Mayfield Memorial Highway 51 as described in subsection (1). 52 Section 2. Kenneth H. “Buddy” MacKay and Jim H. Williams 53 Memorial Overpass designated; Department of Transportation to 54 erect suitable markers.— 55 (1) The overpass on State Road 464/SW 17th Street in Ocala 56 from SW 12th Avenue to U.S. Highway 27/301/441, State Road 57 25/500, SE Pine Avenue in Marion County is designated as the 58 “Kenneth H. “Buddy” MacKay and Jim H. Williams Memorial 59 Overpass.” 60 (2) The Department of Transportation is directed to erect 61 suitable markers designating the Kenneth H. “Buddy” MacKay and 62 Jim H. Williams Memorial Overpass as described in subsection 63 (1). 64 Section 3. Deputy Hal P. Croft and Ronald Jackson Memorial 65 Highway designated; Department of Transportation to erect 66 suitable markers.— 67 (1) The portion of State Road 100 in Union County is 68 designated as the “Deputy Hal P. Croft and Ronald Jackson 69 Memorial Highway.” 70 (2) The Department of Transportation is directed to erect 71 suitable markers designating the Deputy Hal P. Croft and Ronald 72 Jackson Memorial Highway as described in subsection (1). 73 Section 4. Correctional Officer Adam Michael Sanderson 74 Memorial Highway designated; Department of Transportation to 75 erect suitable markers.— 76 (1) The portion of State Road 231 South beginning at the 77 Lake Butler city limit sign in Union County and ending at the 78 Bradford county line is designated as the “Correctional Officer 79 Adam Michael Sanderson Memorial Highway.” 80 (2) The Department of Transportation is directed to erect 81 suitable markers designating the Correctional Officer Adam 82 Michael Sanderson Memorial Highway as described in subsection 83 (1). 84 Section 5. Trooper Ronald Gordon Smith Memorial Bridge 85 designated; Department of Transportation to erect suitable 86 markers.— 87 (1) The bridge on U.S. Highway 19/98 in Citrus County at 88 the Cross Florida Barge Canal is designated as the “Trooper 89 Ronald Gordon Smith Memorial Bridge.” 90 (2) The Department of Transportation is directed to erect 91 suitable markers designating the Trooper Ronald Gordon Smith 92 Memorial Bridge as described in subsection (1). 93 Section 6. Coach Jermaine D. Hall Memorial Highway 94 designated; Department of Transportation to erect suitable 95 markers.— 96 (1) The portion of I-95 between Baymeadows Road and State 97 Road 16 in Duval County is designated as the “Coach Jermaine D. 98 Hall Memorial Highway.” 99 (2) The Department of Transportation is directed to erect 100 suitable markers designating the Coach Jermaine D. Hall Memorial 101 Highway as described in subsection (1). 102 Section 7. Orange Bowl Way designated; Department of 103 Transportation to erect suitable markers.— 104 (1) Northwest 77th Court in Miami Lakes is designated as 105 “Orange Bowl Way.” 106 (2) The Department of Transportation is directed to erect 107 suitable markers designating Orange Bowl Way as described in 108 subsection (1). 109 Section 8. Andrew J. Capeletti Memorial Bridge designated; 110 Department of Transportation to erect suitable markers.— 111 (1) The ramp that connects Northbound Turnpike to 112 Northbound I-75 in Miami-Dade County is designated as the 113 “Andrew J. Capeletti Memorial Bridge.” 114 (2) The Department of Transportation is directed to erect 115 suitable markers designating the Andrew J. Capeletti Memorial 116 Bridge as described in subsection (1). 117 Section 9. Johnny C. Treadwell Highway designated; 118 Department of Transportation to erect suitable markers.— 119 (1) The portion of State Road 46 in Lake County between 120 South Round Lake Road and County Road 435 is designated as the 121 “Johnny C. Treadwell Highway.” 122 (2) The Department of Transportation is directed to erect 123 suitable markers designating the Johnny C. Treadwell Highway as 124 described in subsection (1). 125 Section 10. John Bruce Sweeny Street designated; Department 126 of Transportation to erect suitable markers.— 127 (1) The portion of Herada Street in St. Augustine, in St. 128 Johns County between Menendez Road and Carver Street W is 129 designated as “John Bruce Sweeny Street.” 130 (2) The Department of Transportation is directed to erect 131 suitable markers designating John Bruce Sweeny Street as 132 described in subsection (1). 133 Section 11. Heather Hurd Memorial Highway designated; 134 Department of Transportation to erect suitable markers.— 135 (1) The portion of U.S. Highway 27 in Polk County between 136 Sand Mine Road and U.S. Highway 192 is designated as the 137 “Heather Hurd Memorial Highway.” 138 (2) The Department of Transportation is directed to erect 139 suitable markers designating the Heather Hurd Memorial Highway 140 as described in subsection (1). 141 Section 12. Michael G. Rippe Parkway designated; Department 142 of Transportation to erect suitable markers.- 143 (1) Upon its completion, that portion of SR 739 in Lee 144 County known as the Metro Parkway Extension between Six Mile 145 Cypress Parkway and U.S. 41/Alico Road is designated as the 146 “Michael G. Rippe Parkway.” 147 (2) The Department of Transportation is directed to erect 148 suitable markers designating the Michael G. Rippe Parkway as 149 described in subsection (1). 150 Section 13. Trooper Charles Eugene Campbell Memorial 151 Highway designated; Department of Transportation to erect 152 suitable markers.— 153 (1) The portion of U.S. Highway 19 north of Perry between 154 Slaughter Road and Harrison Blue Boulevard is designated as the 155 “Trooper Charles Eugene Campbell Memorial Highway.” 156 (2) The Department of Transportation is directed to erect 157 suitable markers designating the Trooper Charles Eugene Campbell 158 Memorial Highway as described in subsection (1). 159 Section 14. Samuel B. Love Memorial Highway designated; 160 Department of Transportation to erect suitable markers.— 161 (1) The portion of Sunset Harbor Road between Southeast 162 105th Avenue and Southeast 115th Avenue in Marion County is 163 designated as the “Samuel B. Love Memorial Highway.” 164 (2) The Department of Transportation is directed to erect 165 suitable markers designating the Samuel B. Love Memorial Highway 166 as described in subsection (1). 167 Section 15. Ray Charles Memorial Parkway designated; 168 Department of Transportation to erect suitable markers.— 169 (1) The portion of U.S. Highway 90 within Greenville in 170 Madison County is designated as the “Ray Charles Memorial 171 Parkway.” 172 (2) The Department of Transportation is directed to erect 173 suitable markers designating the Ray Charles Memorial Parkway as 174 described in subsection (1). 175 Section 16. Frank Pasquarella Way designated; Department of 176 Transportation to erect suitable markers.— 177 (1) The portion of Byrd Road/Southwest 40th Street between 178 Southwest 89th Avenue and Southwest 92nd Avenue in Miami-Dade 179 County is designated as “Frank Pasquarella Way.” 180 (2) The Department of Transportation is directed to erect 181 suitable markers designating the Frank Pasquarella Way as 182 described in subsection (1). 183 Section 17. Doolittle Raiders Highway designated; 184 Department of Transportation to erect suitable markers.— 185 (1) The portion of State Road 285 in Okaloosa and Walton 186 Counties that is north of College Boulevard in Niceville is 187 designated as the “Doolittle Raiders Highway.” 188 (2) The Department of Transportation is directed to erect 189 suitable markers designating the Doolittle Raiders Highway as 190 described in subsection (1). 191 Section 18. K. Earl Durden Highway designated; Department 192 of Transportation to erect suitable markers.— 193 (1) The portion of State Road 79 between U.S. Highway 98 194 and the B.V. Buchanan Bridge in Bay County is designated as the 195 “K. Earl Durden Highway.” 196 (2) The Department of Transportation is directed to erect 197 suitable markers designating the K. Earl Durden Highway as 198 described in subsection (1). 199 Section 19. Ludlam Road designated as a state historic 200 road; limitations on the use of public funds.— 201 (1) Southwest 67th Avenue (Ludlam Road) in the City of 202 South Miami and the Village of Pinecrest in Miami-Dade County 203 from Bird Road to Southwest 136th Street is designated as a 204 state historic road. No public funds shall be expended for any 205 of the following purposes: 206 (a) To cut or remove any tree having a diameter at its 207 thickest part in excess of 6 inches within 35 feet of either 208 side of the paved surface of the road, or to engage in an 209 activity that requires the removal without the replacement of 210 such tree. 211 (b) The alteration of the physical dimensions or location 212 of Southwest 67th Avenue, the median strip thereof, or the land 213 adjacent thereto except: 214 1. The routine or emergency utilities maintenance 215 activities necessitated to maintain the road as a utility 216 corridor. 217 2. The modification or improvements made to provide for 218 vehicular ingress and egress of governmental safety vehicles. 219 3. Alterations, modifications, or improvements made for the 220 purpose of enhancing life safety vehicular use or pedestrian use 221 of Southwest 67th Avenue, or both as long as such alterations, 222 modifications, or improvements are heard in a public hearing and 223 subsequently approved by the governing board of the local 224 government in which it is located. 225 226 Nothing in this section shall be construed to prevent the 227 ordinary maintenance and repair of the road or structures, 228 provided the physical dimensions and location of the road and 229 the appearance of any structure are preserved. However, the 230 preservation of the road shall take priority over considerations 231 of traffic management, and the public safety shall not be 232 construed to require alterations in the road when alternative 233 means promoting safety, including more restrictive traffic 234 regulations, are available. 235 (2) The Department of Transportation shall provide for the 236 erection of suitable markers on and along that portion of 237 Southwest 67th Avenue described in subsection (1). 238 Section 20. This act shall take effect July 1, 2009.
