| 6 | Statutes, is amended to read: |
| 7 | 641.407 Minimum surplus.-- |
| 8 | (1) Each prepaid health clinic licensed on or before July |
| 9 | 1, 2009, shall have and maintain minimum surplus in accordance |
| 10 | with the following schedule: On January 1, 2010, $225,000 1996, |
| 11 | $150,000 or 10 percent of total liabilities, whichever is |
| 12 | greater; and on January 1, 2011, $300,000 or 10 percent of total |
| 13 | liabilities, whichever is greater. A prepaid health clinic |
| 14 | licensed after July 1, 2009, shall have and maintain a surplus |
| 15 | of $300,000 or 10 percent of total liabilities, whichever is |
| 16 | greater. A prepaid health clinic licensed on or before January |
| 17 | 1, 2004, and that has an active membership on July 1, 2009, |
| 18 | shall have and maintain a minimum surplus of $150,000 or 10 |
| 19 | percent of total liabilities, whichever is greater. |
