| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |

| 10 | Section 1. Section 316.305, Florida Statutes, is created |
| 11 | to read: |
| 12 | 316.305 Use of cellular telephones in school zones; |
| 13 | enhanced penalties.-- |
| 14 | (1) A person may not operate a cellular telephone while |
| 15 | driving a motor vehicle in a school zone in this state. |
| 16 | (2) A violation of this section is a noncriminal traffic |
| 17 | infraction, punishable as a nonmoving violation as provided in |
| 18 | chapter 318, except that the violator shall pay a fine that is |
| 19 | double the amount provided in chapter 318 for a nonmoving |
| 20 | violation. |
| 21 | Section 2. This act shall take effect July 1, 2009. |
