    1                        A bill to be entitled                      
    2         An act relating to motor vehicles; prohibiting the use
    3         of motor vehicles upon certain exposed lake beds;
    4         amending s. 375.313, F.S.; providing for enforcement
    5         by the Fish and Wildlife Conservation Commission;
    6         providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9         
   10         Section 1. Motor vehicles, as defined in s. 375.312,
   11  Florida Statutes, may not be operated upon the exposed lake bed
   12  of any lake located on public lands or accessible to the public.
   13         Section 2. Section 375.313, Florida Statutes, is amended to
   14  read:
   15         375.313 Commission powers and duties.—The commission shall:
   16         (1) Regulate or prohibit, when necessary, the use of motor
   17  vehicles on the public lands of the state in order to prevent
   18  damage or destruction to such said lands.
   19         (2) Adopt and promulgate such reasonable rules as deemed
   20  necessary to administer the provisions of ss. 375.311-375.315,
   21  except that, before any such rules are adopted, the commission
   22  shall obtain the consent and agreement, in writing, of the
   23  owner, in the case of privately owned lands, or the owner or
   24  primary custodian, in the case of publicly owned lands.
   25         (3) Enforce the prohibition of the use of motor vehicles
   26  upon the exposed lake bed of any lake located on public lands or
   27  accessible to the public.
   28         Section 3. This act shall take effect July 1, 2009.
