    1                        A bill to be entitled                      
    2         An act relating to public school student health
    3         services; amending s. 1006.062, F.S.; providing that a
    4         district school board may authorize a school nurse to
    5         maintain supplies of prefilled epinephrine auto
    6         injectors at schools in the school district; providing
    7         requirements for prescriptions; authorizing use for
    8         emergency treatment; amending s. 1002.20, F.S.;
    9         conforming a cross-reference; providing an effective
   10         date.
   11         
   12  Be It Enacted by the Legislature of the State of Florida:
   13         
   14         Section 1. Present subsections (6) and (7) of section
   15  1006.062, Florida Statutes, are renumbered as subsections (7)
   16  and (8), respectively, and a new subsection (6) is added to that
   17  section, to read:
   18         1006.062 Administration of medication and provision of
   19  medical services by district school board personnel.—
   20         (6)(a) Each district school board may authorize a school
   21  nurse who is licensed under chapter 464 and is employed by the
   22  district school board to maintain at each school in the school
   23  district an adequate supply of prefilled auto-injectors of
   24  epinephrine with a 0.15 mg or 0.3 mg delivery. The school nurse
   25  shall recommend to the district school board the number of
   26  prefilled epinephrine auto-injectors to be maintained at each
   27  school.
   28         (b) A written prescription from a physician or a physician
   29  assistant licensed under chapter 458 or chapter 459 or from a
   30  nurse licensed under chapter 464 is required in order to obtain
   31  prefilled epinephrine auto-injectors for a school district. The
   32  school nurse's name must appear on the prescription, the school
   33  district must be designated as the patient, and the prescription
   34  must be filled at a pharmacy licensed under chapter 465.
   35         (c) Based on a school nurse's training in recognizing an
   36  acute episode of an anaphylactic reaction, the school nurse may
   37  administer epinephrine to a student using an auto-injector if
   38  the school nurse believes that the student is having a life
   39  threatening anaphylactic reaction.
   40         Section 2. Paragraph (e) of subsection (3) of section
   41  1002.20, Florida Statutes, is amended to read:
   42         1002.20 K-12 student and parent rights.—Parents of public
   43  school students must receive accurate and timely information
   44  regarding their child's academic progress and must be informed
   45  of ways they can help their child to succeed in school. K-12
   46  students and their parents are afforded numerous statutory
   47  rights including, but not limited to, the following:
   48         (3) HEALTH ISSUES.—
   49         (e) Contraceptive services to public school students.—In
   50  accordance with the provisions of s. 1006.062(8) s. 1006.062(7),
   51  students may not be referred to or offered contraceptive
   52  services at school facilities without the parent's consent.
   53         Section 3. This act shall take effect July 1, 2009.
