4 | amending s. 106.0706, F.S., which provides an exemption |
5 | from public records requirements for user identifications |
6 | and passwords held by the Department of State, and |
7 | information entered in the department's electronic filing |
8 | system, in connection with electronic filing of campaign |
9 | finance reports; reorganizing the exemption; clarifying |
10 | provisions; removing the scheduled repeal of the |
11 | exemption; providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |

15 | Section 1. Section 106.0706, Florida Statutes, is amended |
16 | to read: |
17 | 106.0706 Electronic filing of campaign finance reports; |
18 | public record exemption confidentiality of information and draft |
19 | reports.-- |
20 | (1) All user identifications and passwords held by the |
21 | Department of State pursuant to s. 106.0705 are confidential and |
22 | exempt from s. 119.07(1) and s. 24(a), Art. I of the State |
23 | Constitution. |
24 | (2)(a) Information entered All records, reports, and files |
25 | stored in the electronic filing system for purposes of |
26 | generating a report pursuant to s. 106.0705 is are exempt from |
27 | s. 119.07(1) and s. 24(a), Art. I of the State Constitution. |
28 | (b) Information entered in the electronic filing system is |
29 | no longer exempt once the report is generated and until such |
30 | time as the report has been submitted as a filed with the |
31 | Division of Elections report. This section is subject to the |
32 | Open Government Sunset Review Act in accordance with s. 119.15 |
33 | and shall stand repealed on October 2, 2009, unless reviewed and |
34 | saved from repeal through reenactment by the Legislature. |
35 | Section 2. This act shall take effect October 1, 2009. |
