A bill to be entitled
2An act relating to a review under the Open Government
3Sunset Review Act regarding participants in government-
4sponsored recreation programs; amending s. 119.071, F.S.,
5which provides an exemption from public records
6requirements for information that would identify or locate
7a child who participates in a government-sponsored
8recreation program or a parent or guardian of the child;
9providing definitions; reorganizing the exemption; making
10editorial changes; removing superfluous language;
11repealing s. 2, ch. 2004-32, Laws of Florida, which
12provides for repeal of the exemption; providing an
13effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Paragraph (c) of subsection (5) of section
18119.071, Florida Statutes, is amended to read:
19     119.071  General exemptions from inspection or copying of
20public records.--
21     (5)  OTHER PERSONAL INFORMATION.--
22     (c)1.  For purposes of this paragraph, the term:
23     a.  "Child" means any person younger than 18 years of age.
24     b.  "Government-sponsored recreation program" means a
25program for which an agency assumes responsibility for a child
26participating in that program, including, but not limited to,
27after-school programs, athletic programs, nature programs,
28summer camps, or other recreational programs.
29     2.  Any Information that would identify or help to locate a
30child who participates in a government-sponsored recreation
31program programs or camps or the parents or guardians of such
32child, including, but not limited to, the name, home address,
33telephone number, social security number, or photograph of the
34child; the names and locations of schools attended by such
35child; and the names, home addresses, and social security
36numbers of parents or guardians of such child is exempt from s.
37119.07(1) and s. 24(a), Art. I of the State Constitution.
38     3.  Information that would identify or locate a parent or
39guardian of a child who participates in a government-sponsored
40recreation program is exempt from s. 119.07(1) and s. 24(a),
41Art. I of the State Constitution.
42     4.  Information made exempt pursuant to this paragraph may
43be disclosed by court order upon a showing of good cause. This
44exemption applies to records held before, on, or after the
45effective date of this exemption.
46     Section 2.  Section 2 of chapter 2004-32, Laws of Florida,
47is repealed.
48     Section 3.  This act shall take effect October 1, 2009.
