3 | Protection and Sustainability Program Trust Fund within |
4 | the Department of Environmental Protection without |
5 | modification; repealing s. 403.891(3), F.S.; abrogating |
6 | provisions relating to the termination of the trust fund, |
7 | to conform; providing an effective date. |

9 | WHEREAS, the Legislature wishes to extend the life of the |
10 | Water Protection and Sustainability Program Trust Fund within |
11 | the Department of Environmental Protection, which is otherwise |
12 | scheduled to be terminated pursuant to constitutional mandate, |
13 | and |
14 | WHEREAS, the Legislature has reviewed the trust fund before |
15 | its scheduled termination date and has found that it continues |
16 | to meet an important public purpose, and |
17 | WHEREAS, the Legislature has found that existing public |
18 | policy concerning the trust fund sets adequate parameters for |
19 | its use, NOW, THEREFORE, |

21 | Be It Enacted by the Legislature of the State of Florida: |

23 | Section 1. The Water Protection and Sustainability Program |
24 | Trust Fund within the Department of Environmental Protection, |
25 | FLAIR number 37-2-2603, which is to be terminated pursuant to |
26 | Section 19(f), Article III of the State Constitution on July 1, |
27 | 2009, is re-created. |
28 | Section 2. Subsection (3) of section 403.891, Florida |
29 | Statutes, is repealed. |
30 | Section 3. This act shall take effect July 1, 2009. |
