Immediately following section 68, Insert new section and redesignate
subsequent sections:
Section 69. There is hereby appropriated $25 million from the General
Revenue Fund to the Office of Tourism, Trade and Economic Development
for a Performance-Based Tax Refund Pool. These funds are contingent on
receipt of an equal amount of increased tax collections in FY 2009-10 to
the state as a result of business activity that would not otherwise have
been attributed to Florida. The Office shall distribute funds to
eligible entities upon receipt of documented tax payments to the state
and determination that applicable economic development criteria have
been met. The Office shall provide a quarterly report of such
distributions, including criteria achieved and offsetting receipt data
for each distribution, to the Legislative Budget Commission.
