A bill to be entitled
2An act relating to outsourcing of foster care and related
3services; amending s. 409.1671, F.S.; providing funding
4requirements for contracts established between the
5Department of Children and Family Services and certain
6community-based agencies; requiring community-based
7agencies to document federal earnings and return
8undocumented earnings to the department; permitting
9contracts with the agencies to be increased by excess
10federal earnings; authorizing the department to outsource
11certain functions of the agencies; permitting the agencies
12to make specified expenditures; specifying method of
13payment for fixed-price contracts; providing an effective
14date.

16Be It Enacted by the Legislature of the State of Florida:

18     Section 1.  Subsection (12) is added to section 409.1671,
19Florida Statutes, to read:
20     409.1671  Foster care and related services; outsourcing.--
21     (12)  A contract established between the department and a
22community-based agency under this section must be funded by a
23grant of general revenue, other state trust funds, and
24applicable federal funding sources. Community-based agencies
25must document federal funds earned, and federal funds earned
26that are not documented must be returned to the department.
27Notwithstanding subsection (8), the amount of the annual
28contract for a community-based agency may be increased by excess
29federal funds earned in accordance with s. 216.181(11). The
30department may outsource programmatic, administrative, or fiscal
31monitoring oversight of community-based agencies.
32Notwithstanding any other provision of law, a community-based
33agency may make expenditures for staff cellular telephone
34allowances, contracts requiring deferred payments and
35maintenance agreements, security deposits for office leases,
36related professional membership dues, costs of food and
37refreshment, and costs of promotional materials. The method of
38payment for a fixed-price contract with a community-based agency
39shall include provisions for a 2-month advance payment at the
40beginning of each fiscal year with equal monthly payments
41thereafter.
42     Section 2.  This act shall take effect July 1, 2009.
