1 A bill to be entitled
2 An act relating to the purchase of commodities and
3 contractual services by local governments; amending s.
4 287.056, F.S.; authorizing special districts,
5 municipalities, and counties to purchase specified
6 commodities and contractual services from purchasing
7 agreements of other special districts, municipalities,
8 or counties; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 287.056, Florida Statutes, is amended to
13 read:
14 287.056 Purchases from purchasing agreements and state term
15 contracts.—
16 (1) Agencies shall, and eligible users may, purchase
17 commodities and contractual services from purchasing agreements
18 established and state term contracts procured, pursuant to s.
19 287.057, by the department.
20 (2) Agencies may have the option to purchase commodities or
21 contractual services from state term contracts procured,
22 pursuant to s. 287.057, by the department which contain a user
23 surcharge pursuant to s. 287.1345 as determined by the
24 department.
25 (3) Special districts, municipalities, and counties may
26 purchase commodities and contractual services, other than
27 services the acquisition of which is governed by s. 287.055,
28 from purchasing agreements of other special districts,
29 municipalities, or counties that have been procured pursuant to
30 competitive bid, requests for proposals, requests for
31 qualifications, competitive selection, or competitive
32 negotiations and that are otherwise in compliance with general
33 law.
34 (4)(3) Agencies and eligible users may use a request for
35 quote to obtain written pricing or services information from a
36 state term contract vendor for commodities or contractual
37 services available on state term contract from that vendor. The
38 purpose of a request for quote is to determine whether a price,
39 term, or condition more favorable to the agency or eligible user
40 than that provided in the state term contract is available. Use
41 of a request for quote does not constitute a decision or
42 intended decision that is subject to protest under s. 120.57(3).
43 Section 2. This act shall take effect July 1, 2009.
