A bill to be entitled
2An act relating to the Lake Asbury Municipal Service
3Benefit District, Clay County; amending chapter 86-392,
4Laws of Florida; increasing the special assessment against
5lots in the district under certain circumstances;
6providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Paragraph (j) of subsection (4) of section 2 of
11chapter 86-392, Laws of Florida, is amended to read:
12     Section 2.  The following is the charter of the Lake Asbury
13Municipal Service Benefit District:
14     (4)  The district is authorized and empowered:
15     (j)  To assess for each year of its operation against every
16lot in the district a special assessment not to exceed $1,000,
17provided that an assessment greater than $100 must be approved
18by an affirmative vote of six or more District Trustees.
19     1.  The assessment above shall be billed and collected as
20provided by Florida law, the rules of the Florida Department of
21Revenue, and appropriate county ordinances, as applicable. The
22procedures of s. 197.0126, Florida Statutes, shall be utilized
23in collection and assessment upon written agreement with the
24County Property Appraiser providing for reimbursement of
25administrative costs incurred. All actions and procedures for
26collections by the Property Appraiser or the Tax Collector shall
27be as described by general Florida law.
28     2.  The special assessments shall be payable at the time
29and in the manner set forth as prescribed in chapter 197,
30Florida Statutes, or as may be subsequently modified by the
31governing body, and shall be and remain liens on the assessed
32property, coequal with the lien of all state, county, district,
33and municipal taxes, and superior in dignity to all other liens,
34titles, and claims, until paid and shall bear interest at a rate
35not to exceed 18 percent per annum.
36     Section 2.  This act shall take effect upon becoming a law.
