6 | Florida Statutes, to read: |
7 | 718.116 Assessments; liability; lien and priority; |
8 | interest; collection.-- |
9 | (11)(a) A notice of delinquency sent to a unit owner shall |
10 | provide an overall total of assessments claimed and shall |
11 | specify each assessment or charge that is claimed by the |
12 | association, listing for each assessment or charge the date of |
13 | the assessment or charge, the principal balance owed for the |
14 | assessment or charge, and affiliated late fees or collection |
15 | charges. |
16 | (b) As to any statute or any provision in the governing |
17 | documents that creates a restriction or condition upon a unit |
18 | owner related to delinquency in the payment of moneys owed to |
19 | the association, no such restriction or condition shall be in |
20 | effect until 20 days after receipt of the delinquency notice by |
21 | the unit owner. If the unit owner objects to the amount claimed |
22 | within such 20-day period by providing proof of payment of the |
23 | sum allegedly owed, no restriction or condition shall be |
24 | enforced until the objection is resolved either by agreement of |
25 | the parties or order of a court of competent jurisdiction. For |
26 | purposes of this paragraph, a "restriction or condition" |
27 | includes any restriction on running for office, holding office, |
28 | serving on a committee, leasing the unit, or using common areas. |
