3     Amendment to Amendment (069089) (with title amendment)
4     Between lines 102 and 103, insert:
5     Section 5.  Section 100.372, Florida Statutes, is created
6to read:
7     100.372  Paid petition circulators.--
8     (1)  DEFINITIONS.--For purposes of this section:
9     (a)  "Department" means the Department of State.
10     (b)  "Initiative sponsor" means the political committee
11registered pursuant to s. 106.03 that has submitted the text of
12a proposed amendment to the Secretary of State.
13     (c)  "Paid petition circulator" means a petition circulator
14who receives compensation or other valuable consideration as a
15direct or indirect consequence of engaging in the activities
16described in paragraph (d), other than for the reimbursement of
17legitimate out-of-pocket expenses incurred by the petition
18circulator in the ordinary course of these activities, as
19specified by rule of the department.
20     (d)  "Petition circulator" means a person who, in the
21context of a direct, face-to-face interaction, presents to
22another person for his or her possible signature an initiative
23petition form.
24     (e)  "Registrant" means a person who is registered with the
25department as a paid petition circulator.
26     (2)  PROHIBITION ON UNREGISTERED PAID PETITION
27CIRCULATING.--A person may not engage in any activities as a
28paid petition circulator in this state without first registering
29with the department. A person or entity may not provide
30compensation or other valuable consideration as a direct or
31indirect consequence of the activities described in paragraph
32(1)(d) to a petition circulator who is not registered with the
33department as a paid petition circulator.
34     (3)  REGISTRATION FOR PAID PETITION CIRCULATORS;
35REQUIREMENTS.--
36     (a)  A person may apply to the department for the
37registration required under subsection (2). The application must
38include:
39     1.  The full name and any assumed name of the applicant.
40     2.  The residential street address of the applicant.
41     3.  The signature of the applicant.
42     4.  Identification of the initiative petitions that the
43applicant will be circulating.
44     5.  The name, street address, and telephone number of the
45person or entity from which the applicant will receive
46compensation as a direct or indirect consequence of the
47activities described in paragraph (1)(d).
48     (b)  If an applicant provides the information identified in
49paragraph (a), the department shall register the applicant and
50assign the registrant a registration number no later than 5
51business days after the date on which the completed application
52is received. As a condition of registration, the registrant
53shall notify the department in writing of any change in the
54information submitted pursuant to this subsection within 10
55business days after such change.
56     (4)  REQUIREMENTS FOR INITIATIVE PETITION FORMS.--Every
57initiative petition form presented by a registrant to a person
58for his or her possible signature must contain the registrant's
59registration number as issued by the department.
60     (5)  RULEMAKING.--The Department of State shall adopt rules
61pursuant to ss. 120.536(1) and 120.54 to administer this
62section, including the adoption of a registration fee necessary
63to cover the department's cost of registration. Funds collected
64from registrants shall be deposited in the Grants and Donations
65Trust Fund of the Department of State.
