| 5 | Section 46. Section 106.1439, Florida Statutes, is amended |
| 6 | to read: |
| 7 | 106.1439 Electioneering communications; disclaimers.-- |
| 8 | (1) Any electioneering communication shall prominently |
| 9 | state: "Paid electioneering communication paid for by (Name |
| 10 | and address of person paying for the communication) , an |
| 11 | organization funded by the top three contributors as described |
| 12 | in s. 106.1439(2), Florida Statutes." |
| 13 | (2) Any electioneering communication shall prominently |
| 14 | state in the disclaimer prescribed in this section the names of |
| 15 | the top three contributors to the electioneering communications |
| 16 | organization during the 12 months preceding the date on which |
| 17 | the electioneering communication is printed or disseminated. |
| 18 | (3)(2) Any person who fails to include the disclaimer |
| 19 | prescribed in this section in any electioneering communication |
| 20 | that is required to contain such disclaimer commits a |
| 21 | misdemeanor of the first degree, punishable as provided in s. |
| 22 | 775.082 or s. 775.083. |
