4     Between lines 86 and 87, insert:
5     Section 2.  Paragraph (l) is added to subsection (13) of
6section 627.6699, Florida Statutes, to read:
7     627.6699  Employee Health Care Access Act.--
8     (13)  STANDARDS TO ASSURE FAIR MARKETING.--
9     (l)1.  In order to improve the ability of small employers
10to obtain information including premium rates for small employer
11health benefit plans and to facilitate the application process,
12all small employer carriers shall use a uniform employee health
13status form. The commission shall adopt rules specifying such
14form. The form shall be designed by the Office of Insurance
15Regulation, in consultation with small employer carriers, to
16permit its use as a written document and through electronic or
17other and alternative delivery formats. The form shall include
18the following health data elements for all persons to be covered
19under the policy that occurred in the 2 years prior to the date
20of completion of the form:
21     a.  Any treatment or diagnosis by any licensed medical
22practitioner.
23     b.  Any procedure or treatment in a hospital,
24rehabilitation program, or surgical center.
25     c.  All current medications prescribed by a licensed
26practitioner.
27     d.  Current diagnosis of pregnancy.
28     e.  Current use of any tobacco products.
29     f.  Pending test results.
30     g.  Workers compensation injury or illness.
31     h.  Tests or treatments recommended but not completed.
32     2.  The form shall require the signature of the employee
33completing the form. Use of a standardized form shall not
34prevent a small employer carrier from obtaining information from
35other sources in order to determine the appropriate premium rate
36for a small employer.
