5 | (3) The department may enter into agreements to operate an |
6 | automated data exchange with financial institutions having |
7 | deposits that do not exceed $50 million. The department shall |
8 | use the information received pursuant to this section only for |
9 | the purpose of enforcing the collection of taxes and fees |
10 | administered by the department. |
11 | (4) The department shall, to the extent possible and in |
12 | compliance with state and federal law, administer this section |
13 | in conjunction with s. 409.25657 in order to avoid duplication |
14 | and reduce the burden on financial institutions. |
15 | (5) The department shall pay a reasonable fee to the |
16 | financial institution for conducting the data match provided for |
17 | in this section, which may not exceed actual costs incurred by |
18 | the financial institution. |
19 | (6) A financial institution is not required to provide |
20 | notice to its customers and is not liable to any person for: |
21 | (a) Disclosure to the department of any information |
22 | required under this section. |
23 | (b) Encumbering or surrendering any assets held by the |
24 | financial institution in response to a notice of lien or levy |
25 | issued by the department. |
26 | (c) Disclosing any information in connection with a data |
27 | match. |
28 | (d) Taking any other action in good faith to comply with |
29 | the requirements of this section. |
30 | (7) Any financial records obtained pursuant to this |
31 | section may be disclosed only for the purpose of, and to the |
32 | extent necessary, to administer and enforce the tax laws of this |
33 | state. |
34 | (8) The department may adopt rules establishing the |
35 | procedures and requirements for conducting automated data |
36 | matches with financial institutions pursuant to this section. |
