       Senator Bennett moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 164 - 168
    4  and insert:
    5  
    6         (d) The releasing mortgagee, grantor, and grantee are
    7  dealing with each other at arm’s length. For purposes of this
    8  subsection, the fact that the parties are related or controlled
    9  by one another is not sufficient evidence alone that the parties
   10  are not dealing with each other at arm’s length.
   11         Section 2. The Department of Revenue may adopt rules
   12  establishing criteria that indicate when parties to a short sale
   13  are not dealing with each other at arm’s length.
