Section 627.7063, Florida Statutes, is created 7 to read: 8 627.7063 Building code effectiveness grading schedule.— 9 (1) As used in this section, the term “sinkhole loss 10 prevention ordinance” means a county ordinance that amends the 11 Florida Building Code and that is intended to reduce the number 12 of sinkhole claims and the severity of sinkhole losses. 13 (2) The commission shall adopt a building code 14 effectiveness grading schedule by rule. The grading schedule 15 shall evaluate the effectiveness of each sinkhole loss 16 prevention ordinance in reducing the number of sinkhole claims 17 and severity of sinkhole losses. Each ordinance shall be 18 evaluated 4 years after the ordinance takes effect. The grading 19 schedule shall be based on the effectiveness of code enforcement 20 in each county and scientific, modeling, and engineering 21 methodologies. The rules shall further mandate insurance premium 22 discounts or surcharges on personal residential property 23 insurance based on a property’s compliance with an ordinance and 24 the grade assigned to the applicable sinkhole loss prevention 25 ordinance. 26 Section 2. This act shall take effect January 1, 2010. 27 28 ================= T I T L E A M E N D M E N T ================ 29 And the title is amended as follows: 30 Delete everything before the enacting clause 31 and insert: 32 33 A bill to be entitled 34 An act relating to sinkhole losses; creating s. 35 627.7063, F.S.; defining the term “sinkhole loss 36 prevention ordinance”; requiring the Financial 37 Services Commission to adopt a building code 38 effectiveness grading schedule by rule to evaluate the 39 effectiveness of sinkhole loss prevention ordinances 40 in reducing the number of sinkhole claims and the 41 severity of sinkhole losses; requiring insurance 42 discounts and surcharges based on the grade assigned 43 to a sinkhole loss prevention ordinance; providing an 44 effective date.
