1 A bill to be entitled
2 An act relating to a review under the Open Government
3 Sunset Review Act; amending s. 125.901, F.S., relating
4 to an exemption from public-records requirements for
5 personal identifying information of a child, or the
6 parent or guardian of the child, which is held by a
7 council on children’s services, juvenile welfare
8 board, or other similar entity, or held by a service
9 provider or researcher under contract with such
10 entity; making editorial changes; saving the exemption
11 from repeal under the Open Government Sunset Review
12 Act; removing the scheduled repeal of the exemption;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Subsection (11) of section 125.901, Florida
18 Statutes, is amended to read:
19 125.901 Children’s services; independent special district;
20 council; powers, duties, and functions; public-records
21 exemption.—
22 (11)(a) Personal identifying information of a child or the
23 child’s parent or guardian of the child, held by a council on
24 children’s services service council, juvenile welfare board, or
25 other similar entity created under this section or by special
26 law, or held by a service provider or researcher under contract
27 with such entity, is exempt from s. 119.07(1) and s. 24(a), Art.
28 I of the State Constitution. This exemption applies to such
29 personal identifying information held before, on, before, or
30 after the effective date of this exemption.
31 (b) This subsection is subject to the Open Government
32 Sunset Review Act in accordance with s. 119.15, and shall stand
33 repealed on October 2, 2009, unless reviewed and saved from
34 repeal through reenactment by the Legislature.
35 Section 2. This act shall take effect October 1, 2009.
