The Committee on Regulated Industries (Dean) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 232 - 240
4 and insert:
5 (8) PENALTIES.—In addition to any other penalty provided in
6 the Beverage Law, the division may suspend or revoke a winery
7 shipper license or impose fines on the winery shipper licensee
8 for any violation of this section.
9 (a) A winery shipper licensee that ships, or causes to be
10 shipped, wine to any person in this state who is under 21 years
11 of age commits a misdemeanor of the first degree, punishable as
12 provided in s. 775.082 or s. 775.083.
13 (b) Any common carrier, permit carrier, or other commercial
14 conveyance that delivers wine directly to any person in this
15 state who is under 21 years of age commits a misdemeanor of the
16 first degree, punishable as provided in s. 775.082 or s.
17 775.083.
18 (c) A person who obtains wine from a winery shipper
19 licensee in violation of this section commits a misdemeanor of
20 the second degree, punishable as provided in s. 775.082 or s.
