A bill to be entitled
2An act relating to mental health and substance abuse
3services; creating s. 394.4612, F.S.; authorizing the
4Agency for Health Care Administration to license
5facilities that provide services as an integrated adult
6mental health crisis stabilization unit and addictions
7receiving facility; providing eligibility criteria for
8treatment services; requiring the Department of Children
9and Family Services to adopt rules; providing an effective
10date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Section 394.4612, Florida Statutes, is created
15to read:
16     394.4612  Integrated adult mental health crisis
17stabilization and addictions receiving facilities.--
18     (1)  The Agency for Health Care Administration, in
19consultation with the Department of Children and Family
20Services, may license facilities that integrate services
21provided in an adult mental health crisis stabilization unit
22with services provided in an adult addictions receiving
23facility. Such a facility shall be licensed by the agency as an
24adult crisis stabilization unit under part IV and must meet all
25licensure requirements for crisis stabilization units providing
26integrated services.
27     (2)  An integrated mental health crisis stabilization unit
28and addictions receiving facility may provide services under
29this section to adults who are 18 years of age or older and who
30fall into one or more of the following categories:
31     (a)  An adult meeting the requirements for voluntary
32admission for mental health treatment under s. 394.4625.
33     (b)  An adult meeting the criteria for involuntary
34examination for mental illness under s. 394.463.
35     (c)  An adult qualifying for voluntary admission for
36substance abuse treatment under s. 397.601.
37     (d)  An adult meeting the criteria for involuntary
38admission for substance abuse impairment under s. 397.675.
39     (3)  The department, in consultation with the agency, shall
40adopt by rule standards that address eligibility criteria;
41clinical procedures; staffing requirements; operational,
42administrative, and financing requirements; and the
43investigation of complaints.
44     Section 2.  This act shall take effect July 1, 2009.
