2An act relating to the Plantation Acres Improvement
3District, Broward County; providing legislative intent;
4amending chapter 2002-367, Laws of Florida; redesignating
5the board of supervisors as the board of commissioners;
6providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  It is the intent of the Legislature in enacting
11this law to provide for a change in the designation of the
12governing body of the Plantation Acres Improvement District from
13a board of supervisors to a board of commissioners.
14     Section 2.  Subsection (3) of section 4, subsections (2),
15(3), and (4) of section 5, section 8, subsection (15) of section
169, section 43, and subsection (7) of section 52 of section 3 of
17chapter 2002-367, Laws of Florida, are amended to read:
18     Section 4.  Definitions.--Unless the context shall indicate
19otherwise, the following words as used in this act shall have
20the following meanings:
21     (3)  "Board" means the board of commissioners supervisors
22of the Plantation Acres Improvement District, or if such board
23shall be abolished, the board, body, or commission succeeding to
24the principal functions thereof or to whom the powers given by
25this act to the board shall be given by law.
26     Section 5.  Board of commissioners supervisors; election;
27organization; terms of office; quorum; report and minutes.--
28     (2)  Each commissioner supervisor, before entering upon his
29or her official duties, shall take and subscribe to an oath of
30office as prescribed in section 298.13, Florida Statutes.
31     (3)  All commissioners supervisors shall hold office for
32the terms for which they are elected or appointed and until
33their successors shall be chosen and qualify. In case of a
34vacancy in the office of any commissioner supervisor, the
35remaining commissioner supervisor or commissioners supervisors
36(even though less than a quorum) may fill such vacancy by
37appointment of a new commissioner supervisor or commissioners
38supervisors for the unexpired term of the commissioner
39supervisor who vacated his or her office.
40     (4)  As soon as practicable after each election, the board
41shall organize by choosing one commissioner supervisor to be
42chair and one to be vice chair of the board and by appointing a
43recording secretary, who need not be a member of the board. In
44the event an employee of the district serves as the board's
45recording secretary, an appointment to such office shall not be
46necessary following an election.
47     Section 8.  Compensation of board.--Each commissioner
48supervisor shall be entitled to receive for his or her services
49an amount not to exceed $300 per month. In addition, each
50commissioner supervisor shall receive reasonable traveling
51expenses for attending district business outside of the
52district. Unless the board by resolution otherwise provides,
53such traveling expenses shall not be in excess of the amounts
54provided by law for state and county officials.
55     Section 9.  Powers.--The district shall have, and the board
56may exercise, any or all of the following powers:
57     (15)  To employ engineers, attorneys, consultants, agents,
58employees, and representatives as the board of commissioners
59supervisors may from time to time determine necessary and to fix
60their compensation and duties.
61     Section 43.  Foreclosure of liens.--Any lien in favor of
62the district arising under chapter 298, Florida Statutes, or
63under this act may be foreclosed by the district by foreclosure
64proceedings in the name of the district in the circuit court in
65like manner as is provided in chapter 173, Florida Statutes, and
66amendments thereto, and the provisions of said chapter shall be
67applicable to such proceedings with the same force and effect as
68if said provisions were expressly set forth in this act. Any act
69required or authorized to be done by or on behalf of a city or
70town in foreclosure proceedings under chapter 173, Florida
71Statutes, may be performed by such officer or agent of the
72district as the board of commissioners supervisors may
73designate. Such foreclosure proceedings may be brought at any
74time after the expiration of 1 year from the date any tax, or
75installment thereof, becomes delinquent.
76     Section 52.  Minimum charter requirements.--In accordance
77with section 189.404(3), Florida Statutes, the following
78subsections satisfy the minimum charter requirements of the
79Plantation Acres Improvement District:
80     (7)  The administrative duties of the board of
81commissioners supervisors shall be as set forth in this act and
82chapter 298, Florida Statutes, as they may be amended from time
83to time.
84     Section 3.  This act shall take effect upon becoming a law.
