A bill to be entitled
2An act relating to warrantless arrests; amending s.
3901.15, F.S.; authorizing an arrest without a warrant when
4a law enforcement officer has probable cause to believe
5that an individual has committed an act of driving under
6the influence in violation of a specified provision or
7unlawfully exhibited his or her sexual organs in public in
8violation of a specified provision; providing an effective
9date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Paragraph (d) is added to subsection (9) of
14section 901.15, Florida Statutes, and subsection (16) is added
15to that section, to read:
16     901.15  When arrest by officer without warrant is
17lawful.--A law enforcement officer may arrest a person without a
18warrant when:
19     (9)  There is probable cause to believe that the person has
20committed:
21     (d)  An act of driving under the influence as described in
22s. 316.193(1).
23     (16)  There is probable cause to believe that the person
24has unlawfully exhibited his or her sexual organs in public in
25violation of s. 800.03.
26     Section 2.  This act shall take effect July 1, 2009.
