Florida Senate - 2009 SB 796 By Senator Baker 20-00608-09 2009796__ 1 A bill to be entitled 2 An act relating to the Police Technology Trust Fund; 3 creating s. 943.082, F.S.; creating the Police 4 Technology Trust Fund within the Department of Law 5 Enforcement; providing for administration of the trust 6 fund and use of moneys therein; requiring balances to 7 remain in the trust fund; providing for future review 8 and termination or re-creation of the trust fund; 9 providing a contingent effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 943.082, Florida Statutes, is created to 14 read: 15 943.082 Police Technology Trust Fund.— 16 (1) The Police Technology Trust Fund is created within the 17 department. Funds credited to the trust fund shall consist of 18 revenues collected from the fee imposed under s. 938.135. The 19 trust fund shall be administered by the department and used to 20 allocate funds to public county or municipal law enforcement 21 agencies to purchase and maintain technology equipment to be 22 used in their law enforcement activities. Equipment that may be 23 purchased and maintained with grants under this section may 24 include, but need not be limited to, in-car cameras and personal 25 digital recorders to record encounters with suspects. The fee 26 collected for each offense shall be distributed only to the law 27 enforcement agency responsible for the arrest for that offense. 28 (2) Notwithstanding s. 216.301 and pursuant to s. 216.351, 29 any balance in the trust fund at the end of any fiscal year 30 shall remain in the trust fund and be available for carrying out 31 the purposes of the trust fund. 32 (3) Pursuant to s. 19(f)(2), Art. III of the State 33 Constitution, the trust fund shall, unless terminated sooner, be 34 terminated on July 1, 2013. Before its scheduled termination, 35 the trust fund shall be reviewed as provided in s. 215.3206(1) 36 and (2). 37 Section 2. This act shall take effect October 1, 2009, if 38 Senate Bill ___ or similar legislation is adopted in the same 39 legislative session or an extension thereof and becomes law.
