       The Committee on Agriculture (Baker) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Subsections (2) and (6) of section 261.03,
    6  Florida Statutes, are amended, present subsections (9), (10),
    7  and (11) of that section are renumbered as subsections (10),
    8  (11), and (12), respectively, and a new subsection (9) is added
    9  to that section, to read:
   10         261.03 Definitions.—As used in this chapter, the term:
   11         (2) “ATV” means any motorized off-highway or all-terrain
   12  vehicle 50 inches or less in width, having a dry weight of 1,500
   13  900 pounds or less, designed to travel on three or more
   14  nonhighway low-pressure tires, having a seat designed to be
   15  straddled by the operator and handlebars for steering control,
   16  and intended for use by a single operator with no passenger.
   17         (6) “Off-highway vehicle” means any ATV, two-rider ATV,
   18  ROV, or OHM that is used off the roads or highways of this state
   19  and that is not registered and licensed for highway use under
   20  chapter 320.
   21         (9) “ROV” means any motorized, recreational, off-highway
   22  vehicle that is 60 inches or less in width, has a dry weight of
   23  1,500 pounds or less, is designed to travel on four or more
   24  nonhighway tires, has nonstraddle seating and a steering wheel,
   25  and is manufactured for recreational use by one or more persons.
   26  However, the term does not include a golf cart as defined in s.
   27  320.01(22) or s. 316.003(68) or a low-speed vehicle as defined
   28  in s. 320.01(42).
   29         Section 2. Subsection (2) of section 316.2074, Florida
   30  Statutes, is amended to read:
   31         316.2074 All-terrain vehicles.—
   32         (2) As used in this section, the term “all-terrain vehicle”
   33  means any motorized off-highway vehicle 50 inches or less in
   34  width, having a dry weight of 1,500 900 pounds or less, designed
   35  to travel on three or more nonhighway low-pressure tires, having
   36  a seat designed to be straddled by the operator and handlebars
   37  for steering control, and intended for use by a single operator
   38  with no passenger. For the purposes of this section, “all
   39  terrain vehicle” also includes any “two-rider ATV” as defined in
   40  s. 317.0003.
   41         Section 3. Subsections (1) and (6) of section 317.0003,
   42  Florida Statutes, are amended, present subsection (9) of that
   43  section is renumbered as subsection (10), and a new subsection
   44  (9) is added to that section, to read:
   45         317.0003 Definitions.—As used in this chapter, the term:
   46         (1) “ATV” means any motorized off-highway or all-terrain
   47  vehicle 50 inches or less in width, having a dry weight of 1,500
   48  900 pounds or less, designed to travel on three or more
   49  nonhighway low-pressure tires, having a seat designed to be
   50  straddled by the operator and handlebars for steering control,
   51  and intended for use by a single operator and with no passenger.
   52         (6) “Off-highway vehicle” means any ATV, two-rider ATV,
   53  ROV, or OHM that is used off the roads or highways of this state

   55  to chapter 320.
   56         (9)“ROV” means any motorized recreational off-highway

   64         Section 4. This act shall take effect July 1, 2009.

   76         safety; amending s. 316.2074, F.S.; redefining the
   77         term “all-terrain vehicle” for purposes of the Florida
   78         Uniform Traffic Control Law; amending s. 317.0003,
   79         F.S.; redefining the terms “ATV” and “off-highway
   80         vehicle” and defining the term “ROV” for purposes of
   81         provisions relating to the titling of such vehicles;
   82         providing an effective date.
