A bill to be entitled
2An act relating to Broward County; providing for
3annexation and deannexation of certain described lands
4within the municipal limits of the Town of Southwest
5Ranches and the Town of Davie; amending chapter 98-521,
6Laws of Florida, as amended; revising the Town of
7Southwest Ranches South Broward Utility Advisory Board
8appointments; providing an effective date.

10     WHEREAS, the Town of Southwest Ranches ("Ranches") and the
11Town of Davie ("Davie") entered into an interlocal agreement
12on June 4, 2008, pursuant to the Florida Interlocal
13Cooperation Act of 1969 relating to the permitting,
14maintenance, and future conveyance of S.W. 54th Place, and
15     WHEREAS, S.W. 54th Place is a rural dead end roadway that
16only accesses a small parcel of land located within the
17Ranches, and
18     WHEREAS, the eastern portion of S.W. 54th Place is divided
19between Davie and the Ranches and the western portion resides
20totally within the Ranches, and
21     WHEREAS, Davie currently neither maintains nor services
22its portion of S.W. 54th Place, and
23     WHEREAS, both municipalities desire to place this entire
24right-of-way into the Ranches, and
25     WHEREAS, in 2008, chapter 98-521, Laws of Florida, was
26amended to provide the Ranches with two members on the South
27Broward Utility Advisory Board, and
28     WHEREAS, the appointments are required to be a water and
29sewer user within the service area, and
30     WHEREAS, since most of the properties in the Ranches have
31wells and septic, very few properties have both water and
32sewer, and
33     WHEREAS, to increase the potential field of board
34appointments the Ranches desires for its appointments to be
35water or sewer users, NOW, THEREFORE,

37Be It Enacted by the Legislature of the State of Florida:
38
39     Section 1.  The lands contained in the following legal
40description are hereby deannexed from the Town of Davie, Broward
41County:

43ALL OF THAT STRIP OF LAND BEING 15 FEET IN WIDTH THE
44SOUTH LIMITS WHICH LIE 15 FEET SOUTH OF THE FOLLOWING

60     Section 2.  The present corporate limits of the Town of
61Southwest Ranches, Broward County, are hereby extended and
62enlarged so as to include, in addition to the territory
63presently within its corporate limits, the following:

83     Section 3.  Section 1 of chapter 98-521, Laws of Florida,
84as amended by chapter 2008-278, Laws of Florida, is amended to
85read:
86     Section 1.  There is hereby created the South Broward
87Utility Advisory Board, which shall be an advisory board of the
88City of Sunrise. The board shall be composed of seven member, as
89follows: two members shall be appointed by the City of Sunrise,
90two members shall be appointed by the Town of Davie, one member
91shall be appointed by the City of Pembroke Pines, and two
92members shall be appointed by the Town of Southwest Ranches.
93Each appointed member from the Town of Southwest Ranches shall
94be a water or sewer user within the service area of the former
95South Broward Utility. All other Each appointed members member
96shall be a water and sewer users user within the service area of
97the former South Broward Utility. Terms of each member shall be
98for 2 years, except that all appointments and retention of board
99members shall be at the sole discretion of the appointing
100authorities.
101     (1)  The responsibility of the board shall be to review and
102advise the City of Sunrise regarding any proposed change by the
103city to the water and sewer rates charged within the area which
104was formerly the South Broward Utility service area. In the
105event of a proposed rate change within such area, the South
106Broward Utility Advisory Board may require the City of Sunrise
107to hire a rate consultant to advise the city regarding such
108proposed rate change.
109     (2)  Within 30 days following notice of a rate change, the
110advisory board shall present a report of its findings to the
111Commission of the City of Sunrise. If presented within the 30-
112day period, the report shall be considered by the commission
113before rates may be altered or changed within the area formerly
114served by the South Broward Utility.
115     (3)  The City of Sunrise shall appropriate not more than
116$25,000 annually for a rate consultant for the South Broward
117Utility Advisory Board, as provided in subsection (1).
118     (4)  The advisory board shall have no legal standing to
119bring any legal action.
120     (5)  The City of Sunrise shall, by ordinance, provide for
121such other procedures and regulations which are not in conflict
122with this act as are necessary for the continued operation of
123the board.
124     Section 4.  This act shall take effect upon becoming a law.
