10 | WHEREAS, the Town of Southwest Ranches ("Ranches") and the |
11 | Town of Davie ("Davie") entered into an interlocal agreement |
12 | on June 4, 2008, pursuant to the Florida Interlocal |
13 | Cooperation Act of 1969 relating to the permitting, |
14 | maintenance, and future conveyance of S.W. 54th Place, and |
15 | WHEREAS, S.W. 54th Place is a rural dead end roadway that |
16 | only accesses a small parcel of land located within the |
17 | Ranches, and |
18 | WHEREAS, the eastern portion of S.W. 54th Place is divided |
19 | between Davie and the Ranches and the western portion resides |
20 | totally within the Ranches, and |
21 | WHEREAS, Davie currently neither maintains nor services |
22 | its portion of S.W. 54th Place, and |
23 | WHEREAS, both municipalities desire to place this entire |
24 | right-of-way into the Ranches, and |
25 | WHEREAS, in 2008, chapter 98-521, Laws of Florida, was |
26 | amended to provide the Ranches with two members on the South |
27 | Broward Utility Advisory Board, and |
28 | WHEREAS, the appointments are required to be a water and |
29 | sewer user within the service area, and |
30 | WHEREAS, since most of the properties in the Ranches have |
31 | wells and septic, very few properties have both water and |
32 | sewer, and |
33 | WHEREAS, to increase the potential field of board |
34 | appointments the Ranches desires for its appointments to be |
35 | water or sewer users, NOW, THEREFORE, |

37 | Be It Enacted by the Legislature of the State of Florida: |

39 | Section 1. The lands contained in the following legal |
40 | description are hereby deannexed from the Town of Davie, Broward |
41 | County: |

60 | Section 2. The present corporate limits of the Town of |
61 | Southwest Ranches, Broward County, are hereby extended and |
62 | enlarged so as to include, in addition to the territory |
63 | presently within its corporate limits, the following: |

83 | Section 3. Section 1 of chapter 98-521, Laws of Florida, |
84 | as amended by chapter 2008-278, Laws of Florida, is amended to |
85 | read: |
86 | Section 1. There is hereby created the South Broward |
87 | Utility Advisory Board, which shall be an advisory board of the |
88 | City of Sunrise. The board shall be composed of seven member, as |
89 | follows: two members shall be appointed by the City of Sunrise, |
90 | two members shall be appointed by the Town of Davie, one member |
91 | shall be appointed by the City of Pembroke Pines, and two |
92 | members shall be appointed by the Town of Southwest Ranches. |
93 | Each appointed member from the Town of Southwest Ranches shall |
94 | be a water or sewer user within the service area of the former |
95 | South Broward Utility. All other Each appointed members member |
96 | shall be a water and sewer users user within the service area of |
97 | the former South Broward Utility. Terms of each member shall be |
98 | for 2 years, except that all appointments and retention of board |
99 | members shall be at the sole discretion of the appointing |
100 | authorities. |
101 | (1) The responsibility of the board shall be to review and |
102 | advise the City of Sunrise regarding any proposed change by the |
103 | city to the water and sewer rates charged within the area which |
104 | was formerly the South Broward Utility service area. In the |
105 | event of a proposed rate change within such area, the South |
106 | Broward Utility Advisory Board may require the City of Sunrise |
107 | to hire a rate consultant to advise the city regarding such |
108 | proposed rate change. |
109 | (2) Within 30 days following notice of a rate change, the |
110 | advisory board shall present a report of its findings to the |
111 | Commission of the City of Sunrise. If presented within the 30- |
112 | day period, the report shall be considered by the commission |
113 | before rates may be altered or changed within the area formerly |
114 | served by the South Broward Utility. |
115 | (3) The City of Sunrise shall appropriate not more than |
116 | $25,000 annually for a rate consultant for the South Broward |
117 | Utility Advisory Board, as provided in subsection (1). |
118 | (4) The advisory board shall have no legal standing to |
119 | bring any legal action. |
120 | (5) The City of Sunrise shall, by ordinance, provide for |
121 | such other procedures and regulations which are not in conflict |
122 | with this act as are necessary for the continued operation of |
123 | the board. |
124 | Section 4. This act shall take effect upon becoming a law. |
