1	A bill to be entitled
2	An act relating to Broward County; providing for
3	annexation and deannexation of certain described lands
4	within the municipal limits of the Town of Southwest
5	Ranches and the Town of Davie; providing an effective
6	date.

8	WHEREAS, the Town of Southwest Ranches ("Ranches") and the
9	Town of Davie ("Davie") entered into an interlocal agreement
10	on June 4, 2008, pursuant to the Florida Interlocal
11	Cooperation Act of 1969 relating to the permitting,
12	maintenance, and future conveyance of S.W. 54th Place, and
13	WHEREAS, S.W. 54th Place is a rural dead end roadway that
14	only accesses a small parcel of land located within the
15	Ranches, and
16	WHEREAS, the eastern portion of S.W. 54th Place is divided
17	between Davie and the Ranches and the western portion resides
18	totally within the Ranches, and
19	WHEREAS, Davie currently neither maintains nor services
20	its portion of S.W. 54th Place, and
21	WHEREAS, both municipalities desire to place this entire
22	right-of-way into the Ranches, and
23	WHEREAS, in 2008, chapter 98-521, Laws of Florida, was
24	amended to provide the Ranches with two members on the South
25	Broward Utility Advisory Board, and
26	WHEREAS, the appointments are required to be a water and
27	sewer user within the service area, and
28	WHEREAS, since most of the properties in the Ranches have
29	wells and septic, very few properties have both water and
30	sewer, and
31	WHEREAS, to increase the potential field of board
32	appointments the Ranches desires for its appointments to be
33	water or sewer users, NOW, THEREFORE,

35	Be It Enacted by the Legislature of the State of Florida:
36
37	Section 1.  The lands contained in the following legal
38	description are hereby deannexed from the Town of Davie, Broward
39	County:

41	ALL OF THAT STRIP OF LAND BEING 15 FEET IN WIDTH THE
42	SOUTH LIMITS WHICH LIE 15 FEET SOUTH OF THE FOLLOWING
43	DESCRIBED NORTH LIMITS OF SAID STRIP:
44	BEGINNING AT THE EAST QUARTER (1/4) CORNER OF SECTION
45	33 TOWNSHIP 50 SOUTH, RANGE 40 EAST, THENCE RUN SOUTH
46	89°43'45" WEST (ON A GRID BEARING) ALONG THE NORTH
47	LINE OF THE SOUTHEAST ONE-QUARTER (1/4) OF SAID
48	SECTION 33 (SAID LINE ALSO FORMING THE NORTH MUNICIPAL
49	BOUNDARY FOR THE TOWN OF DAVIE AND THE SOUTH MUNICIPAL
50	BOUNDARY FOR THE TOWN OF SOUTHWEST RANCHES) 1321.55
51	FEET TO THE TERMINUS OF SAID LINE. TOGETHER WITH THE
52	NORTH 10.00 FEET OF LOTS 17, 18, 19, 20, 21, 43, 44,
53	45, 46, 47, 48, AND 49 ACCORDING TO THE PLAT OF
54	WATERFORD AS RECORDED IN PLAT BOOK 116 AT PAGE 43 OF
55	THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA. SAID
56	LANDS SITUATE, LYING AND BEING IN THE TOWN OF DAVIE,
57	BROWARD COUNTY, FLORIDA.
58	Section 2.  The present corporate limits of the Town of
59	Southwest Ranches, Broward County, are hereby extended and
60	enlarged so as to include, in addition to the territory
61	presently within its corporate limits, the following:

63	ALL OF THAT STRIP OF LAND BEING 15 FEET IN WIDTH THE
64	SOUTH LIMITS WHICH LIE 15 FEET SOUTH OF THE FOLLOWING
65	DESCRIBED NORTH LIMITS OF SAID STRIP:
66	BEGINNING AT THE EAST QUARTER (1/4) CORNER OF SECTION
67	33 TOWNSHIP 50 SOUTH, RANGE 40 EAST, THENCE RUN SOUTH
68	89°43'45" WEST (ON A GRID BEARING) ALONG THE NORTH
69	LINE OF THE SOUTHEAST ONE-QUARTER (1/4) OF SAID
70	SECTION 33 (SAID LINE ALSO FORMING THE NORTH MUNICIPAL
71	BOUNDARY FOR THE TOWN OF DAVIE AND THE SOUTH MUNICIPAL
72	BOUNDARY FOR THE TOWN OF SOUTHWEST RANCHES) 1321.55
73	FEET TO THE TERMINUS OF SAID LINE. TOGETHER WITH THE
74	NORTH 10.00 FEET OF LOTS 17, 18, 19, 20, 21, 43, 44,
75	45, 46, 47, 48, AND 49 ACCORDING TO THE PLAT OF

80	Section 3.  This act shall take effect upon becoming a law.
