    1                        A bill to be entitled                      
    2         An act relating to school food service programs;
    3         amending s. 1006.06, F.S.; revising provisions
    4         relating to school food service programs; requiring
    5         that the Department of Education calculate and
    6         distribute a school district breakfast supplement for
    7         each school year by multiplying the state breakfast
    8         rate by the number of free and reduced-price breakfast
    9         meals served; requiring that the Legislature provide
   10         sufficient funds in the General Appropriations Act to
   11         reimburse participating school districts for the
   12         difference between the average federal reimbursement
   13         for free and reduced-price breakfasts and the average
   14         statewide cost for breakfasts; providing an effective
   15         date.

   17  Be It Enacted by the Legislature of the State of Florida:
   18         
   19         Section 1. Paragraphs (b) and (h) of subsection (5) of
   20  section 1006.06, Florida Statutes, are amended, and paragraph
   21  (i) is added to that subsection, to read:
   22         1006.06 School food service programs.—

   24         (b) Beginning with the 2009-2010 school year, each school
   25  district must annually set prices for breakfast meals at rates
   26  that, combined with federal reimbursements and state
   27  allocations, are sufficient to defray costs of school breakfast
   28  programs without requiring allocations from the district's
   29  operating funds, except if the district school board approves
   30  lower rates.
   31         (h) The department shall calculate and distribute a
   32  annually allocate among the school districts funds provided from
   33  the school district breakfast supplement for each school year by
   34  multiplying the state breakfast rate as specified in the General
   35  Appropriations Act by the based on each district's total number
   36  of free and reduced-price breakfast meals served.
   37         (i)The Legislature shall provide sufficient funds in the
   38  General Appropriations Act to reimburse participating school
   39  districts for the difference between the average federal
   40  reimbursement for free and reduced-price breakfasts and the
   41  average statewide cost for breakfasts.
   42         Section 2. This act shall take effect July 1, 2009.
