A bill to be entitled
2An act relating to instructional materials for K-12 public
3education; amending s. 1006.28, F.S.; deleting a provision
4that restricts the cost to students for replacement of
5certain instructional materials that are lost, destroyed,
6or damaged; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Paragraph (b) of subsection (3) of section
111006.28, Florida Statutes, is amended to read:
12     1006.28  Duties of district school board, district school
13superintendent; and school principal regarding K-12
14instructional materials.--
15     (3)  SCHOOL PRINCIPAL.--The school principal has the
16following duties for the management and care of instructional
17materials at the school:
18     (b)  Money collected for lost or damaged books;
19enforcement.--The school principal shall collect from each
20student or the student's parent the purchase price of any
21instructional material the student has lost, destroyed, or
22unnecessarily damaged and to report and transmit the money
23collected to the district school superintendent. If
24instructional materials lost, destroyed, or damaged have been in
25school use for more than 1 year, a sum ranging between 50 and 75
26percent of the purchase price of the book shall be collected,
27determined by the physical condition of the book. The failure to
28collect such sum upon reasonable effort by the school principal
29may result in the suspension of the student from participation
30in extracurricular activities or satisfaction of the debt by the
31student through community service activities at the school site
32as determined by the school principal, pursuant to policies
33adopted by district school board rule.
34     Section 2.  This act shall take effect July 1, 2009.
