A bill to be entitled
2An act relating to medical expenses of arrested persons;
3amending s. 901.35, F.S.; requiring payments to providers
4of medical services for certain arrested persons to be
5made according to the state's Medicaid rate for such
6services in the absence of a formal, written payment
7agreement; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (2) of section 901.35, Florida
12Statutes, is amended to read:
13     901.35  Financial responsibility for medical expenses.--
14     (2)  Upon a showing that reimbursement from the sources
15listed in subsection (1) is not available, the costs of medical
16care, treatment, hospitalization, and transportation shall be
17paid:
18     (a)  From the general fund of the county in which the
19person was arrested, if the arrest was for violation of a state
20law or county ordinance; or
21     (b)  From the municipal general fund, if the arrest was for
22violation of a municipal ordinance.

24The responsibility of the county or municipality to pay for
25payment of such medical costs shall exist only until such time
26as an arrested person is released from the custody of the
27arresting agency. Absent a formal written agreement between the
28county or municipality and the provider, any payments made by
29the county or municipality under this subsection to a provider
30of medical or related transportation services for an arrested
31person shall be made at the state's Medicaid rate for such
32services.
33     Section 2.  This act shall take effect upon becoming a law.
