    2         An act relating to the practice of architecture and
    3         interior design; amending s. 481.203, F.S.; revising
    4         definitions of the terms “interior design” and “space
    5         planning” to exempt certain drawings and activities
    6         related to the manufacture, sale, and installation of
    7         commercial food service equipment, cubicle
    8         workstations, and similar modular furniture and
    9         fixtures from provisions regulating interior design;
   10         amending s. 481.229, F.S.; exempting certain persons
   11         engaged in the manufacture, sale, and installation of
   12         commercial food service equipment, cubicle
   13         workstations, and similar modular furniture and
   14         fixtures from provisions regulating architecture and
   15         interior design; providing an effective date.

   17  Be It Enacted by the Legislature of the State of Florida:
   18  
   19         Section 1. Subsections (8) and (12) of section 481.203,
   20  Florida Statutes, are amended to read:
   21         481.203 Definitions.—As used in this part:
   22         (8) “Interior design” means designs, consultations,
   23  studies, drawings, specifications, and administration of design
   24  construction contracts relating to nonstructural interior
   25  elements of a building or structure. The term “Interior design”
   26  includes, but is not limited to, reflected ceiling plans, space
   27  planning, furnishings, and the fabrication of nonstructural
   28  elements within and surrounding interior spaces of buildings.
   29  The term does not include related utility rough-in drawings,
   30  engineering drawings, and shop drawings to assist architects,
   31  engineers, interior designers, and general contractors; designs,
   32  consultations, studies, drawings, specifications, layouts, or
   33  floor plans prepared for the sale or installation of commercial
   34  food service equipment or cubicle workstations and similar
   35  modular furniture, shelving, cabinetry, and spatial dividers or
   36  partitions by the manufacturer of such equipment, furniture, or
   37  fixtures or the manufacturer’s representative, distributor, or
   38  dealer, or an employee thereof; or “Interior design”
   39  specifically excludes the design of or the responsibility for
   40  architectural and engineering work, except for specification of
   41  fixtures and their location within interior spaces. As used in
   42  this subsection, “architectural and engineering interior
   43  construction relating to the building systems” includes, but is
   44  not limited to, construction of structural, mechanical,
   45  plumbing, heating, air-conditioning, ventilating, electrical, or
   46  vertical transportation systems, or construction which
   47  materially affects lifesafety systems pertaining to firesafety
   48  protection such as fire-rated separations between interior
   49  spaces, fire-rated vertical shafts in multistory structures,
   50  fire-rated protection of structural elements, smoke evacuation
   51  and compartmentalization, emergency ingress or egress systems,
   52  and emergency alarm systems.
   53         (12) “Space planning” means the analysis, programming, or
   54  design of spatial requirements, including preliminary space
   55  layouts and final planning. The term does not include designs,
   56  consultations, studies, drawings, specifications, layouts, or
   57  floor plans prepared for the sale or installation of commercial
   58  food service equipment or cubicle workstations and similar
   59  modular furniture, shelving, cabinetry, and spatial dividers or
   60  partitions by the manufacturer of such equipment, furniture, or
   61  fixtures or the manufacturer’s representative, distributor, or
   62  dealer, or an employee thereof.
   63         Section 2. Paragraph (c) is added to subsection (6) of
   64  section 481.229, Florida Statutes, to read:
   65         481.229 Exceptions; exemptions from licensure.—
   66         (6) This part shall not apply to:
   67         (c) A manufacturer of commercial food service equipment or
   68  cubicle workstations and similar modular furniture, shelving,
   69  cabinetry, and spatial dividers or partitions or the
   70  manufacturer’s representative, distributor, or dealer, or an
   71  employee thereof, who prepares designs, consultations, studies,
   72  drawings, specifications, layouts, or floor plans for the sale
   73  or installation of such equipment, furniture, or fixtures or who
   74  advertises those services.
   75         Section 3. This act shall take effect July 1, 2009.
