| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Paragraph (qqq) is added to subsection (4) of |
| 12 | section 320.08056, Florida Statutes, to read: |
| 13 | 320.08056 Specialty license plates.-- |
| 14 | (4) The following license plate annual use fees shall be |
| 15 | collected for the appropriate specialty license plates: |
| 16 | (qqq) Fraternal Order of Police license plate, $25. |
| 17 | Section 2. Subsection (69) is added to section 320.08058, |
| 18 | Florida Statutes, to read: |
| 19 | 320.08058 Specialty license plates.-- |
| 20 | (69) FRATERNAL ORDER OF POLICE LICENSE PLATES.-- |
| 21 | (a) The department shall develop a Fraternal Order of |
| 22 | Police license plate as provided in this section. Fraternal |
| 23 | Order of Police license plates must bear the colors and design |
| 24 | approved by the department. The word "Florida" must appear at |
| 25 | the top of the plate, and the words "Fraternal Order of Police" |
| 26 | must appear at the bottom of the plate. |
| 27 | (b) In order to purchase the Fraternal Order of Police |
| 28 | license plate, a person must submit a certified letter from the |
| 29 | Florida State Lodge of the Fraternal Order of Police showing |
| 30 | that he or she qualifies for the use of the Fraternal Order of |
| 31 | Police law enforcement emblem by being a member in good |
| 32 | standing. |
| 33 | (c) The license plate annual use fees shall be distributed |
| 34 | to the Florida State Lodge Fraternal Order of Police Memorial |
| 35 | Foundation to fund its activities, programs, and projects aimed |
| 36 | at preserving, maintaining, and expanding the Florida Fraternal |
| 37 | Order of Police Law Enforcement Memorial. The Florida State |
| 38 | Lodge of the Fraternal Order of Police may retain all revenue |
| 39 | from the annual use fees until all startup costs for developing |
| 40 | and establishing the plate have been recovered. Thereafter, up |
| 41 | to 25 percent of the annual use fee revenue may be used for |
| 42 | promotion and marketing of the specialty license plate and |
| 43 | administrative costs directly associated with memorial programs |
| 44 | and the specialty license plate. The Florida State Lodge |
| 45 | Fraternal Order of Police Memorial Foundation shall use the |
| 46 | remaining funds as follows: |
| 47 | 1. To fund the Florida State Fraternal Order of Police Law |
| 48 | Enforcement Memorial projects. |
| 49 | 2. To provide funds for the expansion, maintenance, and |
| 50 | support of the Florida State Lodge Fraternal Order of Police |
| 51 | Memorial Foundation. |
| 52 | 3. To provide funds to organizations that help support the |
| 53 | families of law enforcement officers who have died in the line |
| 54 | of duty. |
| 55 | 4. To support programs and events that support the Florida |
| 56 | Fraternal Order of Police Law Enforcement Memorial. |
| 57 | Section 3. This act shall take effect October 1, 2009. |
