A bill to be entitled
2An act relating to specialty license plates; amending ss.
3320.08056 and 320.08058, F.S.; creating a Fraternal Order
4of Police license plate; establishing an annual use fee
5for the plate; providing for the distribution of use fees
6received from the sale of such plates; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Paragraph (qqq) is added to subsection (4) of
12section 320.08056, Florida Statutes, to read:
13     320.08056  Specialty license plates.--
14     (4)  The following license plate annual use fees shall be
15collected for the appropriate specialty license plates:
16     (qqq)  Fraternal Order of Police license plate, $25.
17     Section 2.  Subsection (69) is added to section 320.08058,
18Florida Statutes, to read:
19     320.08058  Specialty license plates.--
20     (69)  FRATERNAL ORDER OF POLICE LICENSE PLATES.--
21     (a)  The department shall develop a Fraternal Order of
22Police license plate as provided in this section. Fraternal
23Order of Police license plates must bear the colors and design
24approved by the department. The word "Florida" must appear at
25the top of the plate, and the words "Fraternal Order of Police"
26must appear at the bottom of the plate.
27     (b)  In order to purchase the Fraternal Order of Police
28license plate, a person must submit a certified letter from the
29Florida State Lodge of the Fraternal Order of Police showing
30that he or she qualifies for the use of the Fraternal Order of
31Police law enforcement emblem by being a member in good
32standing.
33     (c)  The license plate annual use fees shall be distributed
34to the Florida State Lodge Fraternal Order of Police Memorial
35Foundation to fund its activities, programs, and projects aimed
36at preserving, maintaining, and expanding the Florida Fraternal
37Order of Police Law Enforcement Memorial. The Florida State
38Lodge of the Fraternal Order of Police may retain all revenue
39from the annual use fees until all startup costs for developing
40and establishing the plate have been recovered. Thereafter, up
41to 25 percent of the annual use fee revenue may be used for
42promotion and marketing of the specialty license plate and
43administrative costs directly associated with memorial programs
44and the specialty license plate. The Florida State Lodge  
45Fraternal Order of Police Memorial Foundation shall use the
46remaining funds as follows:
47     1.  To fund the Florida State Fraternal Order of Police Law
48Enforcement Memorial projects.
49     2.  To provide funds for the expansion, maintenance, and
50support of the Florida State Lodge Fraternal Order of Police
51Memorial Foundation.
52     3.  To provide funds to organizations that help support the
53families of law enforcement officers who have died in the line
54of duty.
55     4.  To support programs and events that support the Florida
56Fraternal Order of Police Law Enforcement Memorial.
57     Section 3.  This act shall take effect October 1, 2009.
