| 3 | licenses; amending s. 322.142, F.S.; authorizing the |
| 4 | Department of Highway Safety and Motor Vehicles to release |
| 5 | to a law enforcement agency film reproductions or |
| 6 | electronic digital images, including updated images, for |
| 7 | inclusion in a facial-recognition biometrics database; |
| 8 | providing that the images will continue to be exempt from |
| 9 | public disclosure while contained in the database; |
| 10 | providing an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Subsection (4) of section 322.142, Florida |
| 15 | Statutes, is amended to read: |
| 16 | 322.142 Color photographic or digital imaged licenses.-- |
| 17 | (4) The department may maintain a film negative or print |
| 18 | file. The department shall maintain a record of the digital |
| 19 | image and signature of the licensees, together with other data |
| 20 | required by the department for identification and retrieval. |
| 21 | Reproductions from the file or digital record are exempt from |
| 22 | the provisions of s. 119.07(1) and shall be made and issued only |
| 23 | for departmental administrative purposes; for the issuance of |
| 24 | duplicate licenses; in response to law enforcement agency |
| 25 | requests; in timely response to a request from a law enforcement |
| 26 | agency for multiple digital database images, including a request |
| 27 | for updated reproductions or updated digital images, for |
| 28 | purposes of law enforcement's inclusion of such images in a |
| 29 | facial-recognition biometrics database, within which such images |
| 30 | shall remain exempt from public disclosure while contained in |
| 31 | the database; to the Department of State pursuant to an |
| 32 | interagency agreement to facilitate determinations of |
| 33 | eligibility of voter registration applicants and registered |
| 34 | voters in accordance with ss. 98.045 and 98.075; to the |
| 35 | Department of Revenue pursuant to an interagency agreement for |
| 36 | use in establishing paternity and establishing, modifying, or |
| 37 | enforcing support obligations in Title IV-D cases; to the |
| 38 | Department of Children and Family Services pursuant to an |
| 39 | interagency agreement to conduct protective investigations under |
| 40 | part III of chapter 39; or to the Department of Financial |
| 41 | Services pursuant to an interagency agreement to facilitate the |
| 42 | location of owners of unclaimed property, the validation of |
| 43 | unclaimed property claims, and the identification of fraudulent |
| 44 | or false claims. |
| 45 | Section 2. This act shall take effect July 1, 2009. |
