A bill to be entitled
2An act relating to color photographic or digital imaged
3licenses; amending s. 322.142, F.S.; authorizing the
4Department of Highway Safety and Motor Vehicles to release
5to a law enforcement agency film reproductions or
6electronic digital images, including updated images, for
7inclusion in a facial-recognition biometrics database;
8providing that the images will continue to be exempt from
9public disclosure while contained in the database;
10providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Subsection (4) of section 322.142, Florida
15Statutes, is amended to read:
16     322.142  Color photographic or digital imaged licenses.--
17     (4)  The department may maintain a film negative or print
18file. The department shall maintain a record of the digital
19image and signature of the licensees, together with other data
20required by the department for identification and retrieval.
21Reproductions from the file or digital record are exempt from
22the provisions of s. 119.07(1) and shall be made and issued only
23for departmental administrative purposes; for the issuance of
24duplicate licenses; in response to law enforcement agency
25requests; in timely response to a request from a law enforcement
26agency for multiple digital database images, including a request
27for updated reproductions or updated digital images, for
28purposes of law enforcement's inclusion of such images in a
29facial-recognition biometrics database, within which such images
30shall remain exempt from public disclosure while contained in
31the database; to the Department of State pursuant to an
32interagency agreement to facilitate determinations of
33eligibility of voter registration applicants and registered
34voters in accordance with ss. 98.045 and 98.075; to the
35Department of Revenue pursuant to an interagency agreement for
36use in establishing paternity and establishing, modifying, or
37enforcing support obligations in Title IV-D cases; to the
38Department of Children and Family Services pursuant to an
39interagency agreement to conduct protective investigations under
40part III of chapter 39; or to the Department of Financial
41Services pursuant to an interagency agreement to facilitate the
42location of owners of unclaimed property, the validation of
43unclaimed property claims, and the identification of fraudulent
44or false claims.
45     Section 2.  This act shall take effect July 1, 2009.
